I suppose that in a strangulation situation, if there is evidence that the victim's breathing was significantly impacted for a period of time, that could potentially qualify as substantial risk of death.
Could be damage to the trachea or vocal cords. As you noted, we have few details and we're merely speculating.

Setup and creativity. There's a reason HMS for example is still the cream of the crop.
I guess when I use the term CAR i'm thinking of the actual car. A mechanical device. Not who is driving or adjusting it. They all the same. That's why HMS is in trouble right now. Most of the teams finishing 15th thru 3?th consistently are lacking in setup & creativity. I wouldn't call them junk. Inept? Maybe. probably semantics tho...
 
They probably will: consider the Outlaw Kurt Busch versus Assassin Patricia Driscoll case. He was suspended and only reinstated after the case fell apart.
The obvious difference in these situations is that Kurt was never arrested, charged etc. Nothing. And there never really was a "case" to even fall apart. That entire fiasco of a trial was over a protection order. Why Kurt even bothered defending the order is still one of life's great mysteries. He should have just said, "fine, issue it, I don't plan on being anywhere near you" and that would have been that.

And let's face it, the only reason he was even suspended was because the Assassin did a full blown media tour (Good Morning America, Fox & Friends etc) in the days leading up to the Daytona 500. Definitely the kind of behavior we often see with victims of abuse, amirite?

He did. I don’t necessarily think it changes much of anything.
Not directly. But it could indicate some genetics associated with violence and agression.

We don't know for sure though.

That honestly changes my outlook on this conversation.

Especially since North Carolina is one of the states that outright criminalizes a proven effective treatment for it.
Oh ****. I didn't know this either. Asperger's actually hasn't been a diagnosis in the DSM for a decade, it's symptoms are categorized under Autism Spectrum Disorder today, which has different specifiers now.

In prior versions, Asperger's was typically less severe than Autism when it came to impairment. At the least, Asperger's, as it was, usually wasn't as commonly associated with the emotional regulation and violence issues that tend to come with more severe diagnoses of Autism. And even if so, people with such a deficit in emotional regulation usually end up receiving more intensive treatment.

I've worked with folks who have had comorbid autism diagnoses, and you wouldn't even know it.

I don't know, but today's Autism spectrum is so broad, that I can't say for certain that this would change anything for me.

Folks diagnosed with Borderline Personality Disorder have committed crimes.. psychotic folks have also committed crimes due to command hallucinations. This doesn't necessarily excuse them from being guilty.

Although I can certainly sympathize with the lack of control and autonomy that motivated violence.

Well that's unusual - I think that's either because there are new charges or he violated the terms of his bond release.

Brianchi reporting that it was for two additional charges, an assault charge and a charge of “communicating threats.”

Apparently Ware will remain in custody through the weekend and have a hearing on Monday.
