Busch drops assault complaint against Spencer

DETROIT – NASCAR driver Kurt Busch dropped his assault complaint against rival Jimmy Spencer, who punched him in the face after a race last month at Michigan International Speedway.
A spokesman for Busch called the Sheriff's Department Wednesday, asking that the case be dropped, sheriff's Capt. Jack Welsh said Friday. Welsh said the representative told him NASCAR's penalties against Spencer were satisfactory.

Busch was left with a bloody nose and chipped tooth during the Aug. 17 fight between two of the more aggressive drivers in the Winston Cup series.

NASCAR barred Spencer from driving in a NASCAR-sanctioned events for a week and fined him $25,000. Busch was fined $10,000. NASCAR placed both men on probation until the end of the year.

Spokesmen for Spencer and Busch did not immediately return calls.

Spencer approached Busch's car in the garage area following the race in Brooklyn, Mich., and hit Busch as he sat in his car.

Tapes of radio chatter between Busch and his crew revealed he intentionally tried to flatten Spencer's bumper during the race. An in-car camera showed Busch provoked Spencer in the garage area, possibly leading to the punch.

Less than a week after the race, Busch insisted he was not trying to harm Spencer when he bumped him.

"There isn't a race that goes by where someone doesn't employ a racing tactic like Jimmy and I did to one another last week at Michigan," Busch said. "You might try to take the guy's air off his spoiler or loosen him up, or you might try to knock his fender in to make his car push.

"I have never intentionally tried to hurt Jimmy Spencer. It's an unwritten rule among the drivers to never overstep that boundary."

The fight in Michigan was the latest episode in a conflict between Spencer and Busch. But despite on-track jockeying and harsh words there had been no previous physical confrontations.

Spencer apologized Aug. 29 before the opening practice for the Southern 500.

"I'm sorry for what happened and it's behind me, and I hope everybody learned from it. I know I learned from it," he said. "I respect everyone in this garage area. I'm sorry for what happened at Michigan."

Busch was heartily booed after winning in Bristol, Tenn., on Aug. 23, and his sponsor, Rubbermaid Newell, lectured the 25-year-old driver and planned to set up a program to help guide his behavior.

When I asked last week if Busch could file charges, somebody on the forum told that he could not. well, I wish that I could remember who said that so I could tell them that they don't know as much as they thought they did..
 
I wonder if they'll be taking anger management classes together

That would be me. If you read the article, it says
asking that the case be dropped
the column title is misleading. He can only request that the charges be dismissed, but it is ultimately up to the district attorney to oblige the request. In other words, stay tuned........

The DA never filed charges so Kurt could not possibly have asked that charges be dropped.

Not only DOES fender/fairing smashing take place, it happens a lot.

Stock car racing is NOT and never has been a Gentleman's Sport and the current furor re Spencer/Busch reminds me of stuff that would be better left as headline splash for The National Enquirer.
 
Hopefully at this point the DA and staff will let the matter go. There might be some fear that an attention hungry member of the system will see an opportunity to get some ink and air.

Without the willing cooperation of the complainant the likelihood of successful prosecution of any charges would be dim. Generally this will end the process.

Also i wanted to add to this. Nascar and the Police Officer has the Radio Communications means that Kurt Busch would be more into trouble then Jimmy Spencer.

Kurt Busch was chatting with Jimmy Fenning over the Radio about cutting down his tire and causing a accident. Jimmy Spencer was going 199mph going into turn number 4 @ MIS when Busch was trying to wreck him, if he accomplish that Jimmy Spencer would go head first in the wall and probably be killed.

Nascar Officals and Nascar has all the Radio Communications about this sitution. This means if Kurt Busch and Jack-A Roush took Spencer to court. Jimmy would be fined but Kurt Busch would've been charge with more than a assult.

Soryy wlfyk...that is not at all what Kurt said. Not one word of it. Kurt never said one word about a tire or causing an accident. The transcripts of that radio communication are all over the place.

Tell ya what....you go find any transcript where Kurt says that and link in here. Otherwise you are putting words in Kurts mouth, not commenting on what was said.

What Kurt said he was trying to do was "flatten the fender"...........and on this board it was discussed that this was something the drivers might be trying to do. Not to cut a tire, but to change the aero characteristics of the front end. Something I had noticed several times this season when side to side contact was made by several drivers and seemed inexplicable. Only Kurt said what he did that it was figured out.

You could have been in the NASCAR trailer, in a race car, in the TV booth, or on the moon that does not mean Kurt said what you claim he did. That does not address the issue.

FACT: Kurt did not say he was gonna cut a tie or wreck anyone.

In order to disprove that statement you need something to verify what he said. Where you were or were not is 100% irrelevent.
 
At the track working? You traveled all the way from Delaware to Michigan as part of your job? What do you do?

I suppose you had Kurt's radio tuned in to yours while you were working?

Now I'm not here to unconvince you of anything. What I will do (like HS) is ask you to just find one quote from Kurt (with a link to where you found it) about flattening the tire.

Been here been there. Decided it was time to check this joint out again as I had heard it had been cleaned up a bit and might once again have potential as a fairly friendly place.

Very picky about where and who I hang with on the net.

Well, I'll still not say perzactly why I stopped coming here so often. Let's just say that I found out someone was using a number of multiple screen names and that rather than exposing them, I left.

Knuckleheads I can handle, hanging with the blatently dishonest I cannot.

If you were at the race, then this is what you heard:
While Sunday's race was under caution on Lap 135 and Busch riding on the backstretch, the following exchange took place, which could be picked up on Busch's team's scanner frequency:

Busch: "See, I'm not very good at being bad. I was trying to flatten the seven car fender and I got mine. I needed to be further forward on his car."

Response from Pit: " They just showed that on TV. You just missed by about an inch or two Ah, not far enough forward."

Busch: "Inches only count unless you're playing Horseshoes and hand grenades. Ah, I don't wanna play either with that clown."

Response from Pit: "I hear ya, man."

MIS doesnt have those people jobs.

I am Kyle, I work Part-Time for Morgan Shepherd Racing has a pit crew member for all three events he does. Basically yall can yell and bit*h and call me names, say I am lieing or anything.

You need to take a chill pill, dude. No one has ever called you a liar. All we have ever asked is that when you make a statement, please substatiate your statements with either a printed source or something of that nature. Some of the things that you have said can, and have been proven to be incorrect.
