The National Stock Car Racing Commission has upheld NASCAR's $10,000 fine and 25-point penalty levied against Nextel Cup driver Dale Earnhardt Jr. for using profanity in a live, post-race interview following the October 10 race at Talladega, Ala., ThatsRacin.com has learned.
 
Nascar's hands were tied. Jr swore and had to pay the price. I hate it for him.

I wonder if Nascar will change their outlook on off track penalties next year.
 
No big surprise there. I haven't heard of an appeal over turning a penalty yet.
 
Well!!!!! Glad NASCAR didn't cave in.

And they said they are going to continue to enforce the
profanity ruling. If you can read their lips plainly as in the case of Mike Wallace
then you will get fined even though the 5 sec delay will prevent the word from being heard on the airwaves.
 
My guess is NASCAR will drop the point portion of the penalty for use of profanity and will increase the size of the fine.

NASCAR must determine what happens OFF the track gets one form of penalty what takes place on the track requiresa different approach.

NASCAR has been very good about changing the rules when they see an irregularity and do not be surprised to see a change in this rule beginning the 2005 season. Unfortunately, it is too late for the driver of the 8 car this year.

As much as I hate Dale Jr. I still think it should have been removed. Neither Nascar or NBC was holding a gun to anyone's head forcing them to watch Nascar.
 
what kind of reaction do you think will come if jr loses the title by 21 points, we all know that he is the most popular driver, does anyone think helton and crew are worried that there will be a fan revolt and lower ticket sales if this happens ? personally i really don't give a rats ass who wins the title, i am so mad at nascar for their sainatition (sp) of the sport it makes me want to :bleh:

Well, didn't figure it would change. But, I still feel that they need to take a look at how they penalize off the track infractions! There should be a hefty, $200,000 or more, fine!

Jr will overcome! :D

The 5 second delay was to protect them from repercussions from the FCC. Now the real ? is will they still deduct points if the lips can be read? The precedent has been set. I would guess that unless they change the rules they will have to. Rules is rules, fair is fair. What is Lil'E today maybe your driver tomorrow.

I'd still like to see the fines as a % of the purse and not a set amount. $10K from a $70K purse hurts a lot more than $10K from a $300K purse. Make the fines 2%. Make them fair...

As to points deduction, they should, IMO, be a part of the equation but only after X number or transgressions where you need to get that driver's attention. I would think that would work better than "probation".

And, while I'm on a roll, even tho I hate this C4C format it does need to be tweaked. I would make the points difference 25 points between the drivers, or the actual point difference if it was less than 25 points. ie. if the 4th place driver was more than 25 points behind the 3rd place then he is 25 points back. But, if he was 12 points back he would remain 12 points back. The 5th place points is then determined from there. This rewards the driver in 1st for his consistency over the 26 races and doesn't take out the 10th place driver completely. It gives the drivers at the front an advantage they earned. A blending of the 2 systems.
