Gillett Evernham Motorsports has filed suit against Robby Gordon saying the owner/driver of Robby Gordon Motorsports violated terms of a tentative agreement that would have sold his team to GEM for $23.5 million earlier this year. The deal, agreed to Jan. 29, was pending an audit and other due diligence from GEM, which could have adjusted the price. If the deal had gone through, Gordon would have had a four-year driving contract with GEM that would have paid him $3 million annually plus 45 percent of race winnings as well as insurance and other provisions customary for NASCAR driver agreements – a package likely worth at least $5 million annually. Gordon also could have had a spot on the team’s board of directors. GEM would have acquired Gordon’s shop and property in Charlotte. As part of the agreement, GEM pledged to provide Gordon with all “racing infrastructure” and to support the Gordon’s car “in substantially the same manner in which GEM supports its most supported car in the NASCAR Sprint Cup” for the 2008 season. Three days after the agreement was signed, GEM and Gordon announced a technical, manufacturing and marketing partnership. At that time, GEM owner George Gillett, in an interview with NASCAR Scene, stated that he did not buy Gordon’s operation and was more likely to add a fourth car to his stable and hoped Gordon would add a second or third car to his.
“We categorically reject the allegations that are contained in the complaint, and the truth will come out if the case proceeds,” Gordon said in a statement released through his race team. “In the meantime, we think it is best to allow that to happen in the court proceedings rather than in the media. Therefore, although we have much to say, we won’t be making a further statement about it at this time.” GEM spokesman Drew Brown said the team would not comment on the lawsuit. maybe it's just me, but somethin about this doesn't sound right....... Why on Earth would Robbie screw this deal up???? Either he is really dumb, or the whole story is not out yet..........

Maybe Ray is looking for some extra dough to keep his struggling team out of the drain that it has been circling.
Ray hasn't had any success since he left his crew chief position for Jeff Gordon...:D
 
Anyone watch Tradin' paint yesterday? According to Jenna Fryer of AP Gillette accused Robby of talking to another team when he wasn't supposed to. Robby said he talked to Bill Davis but it was at Gillette's request. Jenna said "Robby does some dumb stuff but I don't think he did anything wrong this time."
 
#7-Robby Gordon said he still wants to merge with Gillett-Evernham Motorsports, despite a suit just filed against him by Gillett-Evernham. Gordon, who has been using engines supplied by Gillett-Evernham this season, said he expects to have a legal response in the next few days to the lawsuit filed against him by the Ray Evernham-George Gillett operation that claims a breach of contract on a proposed sale of Gordon's NASCAR operation to Evernham-Gillett. But already there are rumblings in the NASCAR garage over what might be the real story behind the suit: whether Evernham and Gillett don't really want to do that deal with Gordon any more, perhaps because they have a better proposal, or for some other reason.
One key part of the entire situation is Gillett's plan to move his team from its relatively isolated Statesville airport location down much closer to the Charlotte-Concord heart of the sport. Evernham and Gillett haven't been here to explain the situation from their viewpoint, but Gordon said he still wants to do the deal with them. One key to the proposed $20 million deal apparently is a sale of Gordon's shop and real estate -- some prime racing real estate -- to Evernham and Gillett.
There is increasing speculation that Chip Ganassi -- a Dodge team owner like Evernham, Gillett and Gordon -- might also be a potential merger partner with Evernham and Gillett. And Ganassi has prime real estate too, right next to the Concord airport. "Unfortunately I guess you'll have to learn more about all that in our answers to their complaint," Gordon said. "But we have a deal with them, we have a contract that is still in effect. What they have asked -- I wouldn't say it's so much against Robby Gordon, but they have asked for release from the contract. But we've already done so many things together that I don't know if that's possible." Might Evernham and Gillett want to drop the Gordon deal so they can do a deal with someone else? "Maybe that's what the case is, but I'm not privy to that information, so I don't know," Gordon said.(Winston Salem Journal)(9-8-2008)
 
UPDATE: Robby Gordon Motorsports and Gillett Evernham Motorsports issued a joint statement today confirming that all issues between them are resolved. As previously announced, the two auto racing firms acknowledged that they acted in good faith in connection with their former merger plans. Recent news reports concerning a lawsuit between RGM and a business broker have suggested that RGM and GEM are in a continuing legal dispute. Those news reports are incorrect. GEM is not a party to RGM's lawsuit, and no claims are being asserted against GEM.(RGM/GEM PR)(10-4-2008)
