Morning Happy and and all you other forum folks. Is it the weekend yet? I need it already! Supposed to be in court this morning to fight a speeding ticket... has anyone ever fought one on here and actually won? What do you think my chances are? :huh: Anyway ya'll have a great day!
 
Dee there is all kinds of info out there on how to beat one. There is actually a book I heard about that tells you how to beat it. Most of the tips help when you are prepared with them when you get pulled over. Such as "officer, I don't know exactly how fast I was going because I had my eyes on the road the whole time and I was just just going the same speed as everyone else".

If you really want to take it to the extreme, you can do things like ask to reschedule your trial for a different day of the week. The officer who gave you the ticket has to be there when you actually contest it. Therefore, they will usually schedule all of his trials for a day he can be there. If you can get it for a different day of the week, usually the officer can't make it and they throw it out.

Also, if you really want to beat this thing (and it is a speeding ticket) ask for the calibration records of the radar gun used by the officer. If they can not produce very detailed documentation as to it's calibration history the judge has to throw the case out also. Just FYI. ;)
 
Hey 4X thanks for the info, there are several reasons why I am contesting it first off she wrote me the ticket in my own drive, the last time I got clocked on my road the officer said he couldn't write me one since I was already on my property. ^_^ Second where she clocked me was over a mile and a half down the road, she didn't even turn her lights on til she was in my drive. She told me I was going "over 75" but only wrote the ticket for 75. And wrote the wrong intersection for where I would have been clocked. And last got the color of the vehicle I was driving wrong. You think I have enough to go on?
 
It sounds like enough to me. But then, I love a good fight even if I don't win. I don't know how much more it would cost you in "court costs" to fight it and lose. But, I can't imagine it would be much more than the rediculous charges they hit you with when you don't fight it. I would probably go for it.

That part doesn't sound right to me. I just can't see where being on your own property at the time of receiving the ticket would make any difference since the alleged violation occured on a public street. But, I could be wrong. :huh:
 
Dee, I guess it depends on the state but I believe that even if you get into your driveway, you are not immune to being written up for a violation.

75 MPH? What was the speed limit if I might ask? Just curious.

4X made some good points.

Personally, I would probably spring for a lawyer that handles these cases. Usually can get it reduced down to defective equipment charge, you pay court costs but get no points on your license. Of course, the lawyer is several hundred dollars but you make that up on the money you save on rising insurance rates.

But if you feel that you are innocent and want to go to court on your own........ hey, what the heck! You might lose more if you don't go for it.

The weather here in Charlotte is beautiful. A hint of what is in store for my favorite season....fall.

Got to get busy and get some work done outside. Got the week off but next Tuesday it is off to Dover and 4 straight weeks on the road.

The race season is starting its slow wind down through the enjoyable fall weather. A beautiful time to be on the road.

I'll be doing shows in the Atlanta area for 5 days during race week.... Lawrenceville, Marirtta, Douglasville, McDonough and Fayetteville Georgia.

Got to be in Chicago during the Charlotte race. Dang! I hate missing that one.

I don't agree with switching to a night race for Charlotte in October. The weather can be rather chilly in October at night. I remember one race about 10 years ago that I about froze to death in the daytime with the wind blowing through the speedway.
 
I'll be in Atlanta for the race. Going to the Cup race on Sunday. Saturday I'll be in Fayetteville at a 'net buddy's house for a slam-bang party. About 25 of my internet buds will be there, too.

On Monday, the hubby and I are going up to Welcome to see the new RCR museum. And, hopefully, visit with a friend that lives in Cornelius.

TRL, the RCR museum is a winner!

I drove thru Welcome on Sunday on my way back from Richmond. Looking for a place to eat at lunchtime. There is a new Japanese restaurant in Welcome (imagine that) but it was slam-full of people and I didn't want to wait. So I ended up in at the Bojangles. :D

I'll be at the Wal-Mart in Fayetteville on 10/25 from 10AM until 4PM.
Look for the Stacker2 car.

Stop by and I'll have some goodies for ya. :)
