Heading to Thompson yesterday morning for the Mods race, taking one of my famous back road shortcuts.
Come over the crest of a small hill, there's a quaint New England style church on the right, parking on both sides of the road. Going 20-25 or so and just before the crosswalk guy throws his drivers door open and I swerve to the left. Know anything about those fiberglass poles they bolt in the road to warn you of crosswalks? Boy them sumbeeches make a hellofva noise and really fly when you nail'em.

I stopped and I'm shaken up. I;m thinking the worst, that could have been a person I nailed. And then the good christian appears at my door ranting and raving I almost killed him. Told him to back off or his obit won't say "almost". Off duty crossing cop called it in, and the good christian who really had a foul mouth in front of everyone, including his wife and kids, ended up getting ticketed for "unsafe exit".

I have a bent license plate and bracket, minor crack in the grille, small dent in the hood and wounded pride. If I had bumped into a tree or pole I'd live with it. If he hadn't been such a A-hole I still would have live with it. But not now.

btw, I turned aound and went home, I'd had enough excitement for the day.
 
wonder if his ins would have covered it being his fault in presence of an officer?
 
If the donkey who cause the accident was charged, he should be held responsible for the repairs. But it might depend on SST's insurance....
 
I've already reported it, somebody will pay for the post. My insurance will pay then subrogate for the post payment from his company. Damage to my truck will be under my $1,000 ded I'm sure.
That leaves several options:
No contact between vehicles throws this into a big gray area. His company can deny based on that fact alone.
More than likely I'll end up in small claims court using the police report and narrative along with his ticketed offense as my proof of his negligence. It's a minor amount and they won't send and pay for a lawyer to defend. I'll win, hopefully, on default 2-3 years down the road. PITA
