Judge sides with NASCAR, ISC in Kentucky Speedway lawsuit

A judge has ruled in favor of NASCAR and International Speedway Corp. in an anti-trust lawsuit filed by Kentucky Speedway's owner.

U.S. District Court Judge William O. Bertlesman's opinion was issued Monday morning. In it, he ruled that even by granting Kentucky Speedway the benefit of the doubt on all reasonable inferences, the track failed to make a case.

Kentucky Speedway alleged that NASCAR, which is privately held by members of the France family and sanctions races, conspired with ISC, which is publicly traded but under majority control by the Frances, to keep track Kentucky from getting Sprint Cup races.

NASCAR and ISC had sought a summary judgment from the court before a trail that had been scheduled for March.

In a statement released Monday, officials of the sanctioning body said, "NASCAR is very pleased by the U.S. District Court’s ruling to dismiss this case. It puts an end to any question about which locations and dates NASCAR can operate its races.

"Like other sports such as the NFL, MLB and the NBA, NASCAR can host its events where it decides is best for the sport and its fans."

Kentucky Speedway has the right to appeal Bertlesman's ruling.
 
Kentucky (unlike Caliboreya)...

... sells out every race. NASCAR's getting their money, and if they only have to run Nationwide to do so, great. Screw the fans who shell out the money and want to see a Cup race there. :rolleyes:

I'd rather them race at Kentucky and Nashville over California, Pocono and Texas.

How do you expect to keep fans when you put the worst race on the schedule right behind the best races, twice. Daytona and all the hype leads up to California, which is boring as hell and overshadowed by the Oscars. Bristol is followed by California.

Two races there is just 2 too many to stand. The track can only seat 80,000 people and they seem to have a problem selling that many tickets.
 
But the point is it's Nascar's call as to where to race and they shouldn't be forced to go to a venue if they don't want to. They are a private enterprise, answerable only to their shareholders. If they crunch the numbers and see that they would make more money dropping one track for another we really can't complain too much.
As to Kentucky, yeah it's a shame but no one is stopping them from having races there every weekend if that's what they want to do. Those races just won't be Cup.
 
as long as kentucky doesnt go the way of PPIR in the long run i think they'll be able to hold up with the ASA and ARCA races at a minimum.
 
dont forget frank kimmels street stock race. As big as thats starting to get should be helping them out some.

Certainly is the way I see it. I'm not a NASCAR defender, but its there game, they can play it where they want. Duane
