Kurt Busch owes more than $1 million to sports agency, lawsuit claims

According to MLive.com, Sports Management Network alleges the veteran driver has yet to pay $930,450 dating back to March 2016 and owes an additional $540,000 that has not yet been invoiced for the 2018 race season.

The report said Busch, who abruptly ended his relationship with Sports Management Network in 2016, intends to fight the lawsuit, which includes nine counts such as breach of contract and fraudulent misrepresentation.

At issue is a modification to Busch's contract, which SMN says was honored through the first quarter of 2016.

OAKLAND COUNTY, MI -- Troy-based Sports Management Network alleges NASCAR driver Kurt Busch owes more than $1 million in contractual obligations after he abruptly ended his contract.

A lawsuit filed in U.S. District Court this month claims Busch, a former NASCAR champion, agreed in or around July 2012 to the compensate 10 percent of all revenue paid from personal services agreements to the network under a representation agreement beginning in January 2013.

The move took place after "it became apparent that the money Defendants would receive in 2012 from KB's professional driving activities would be a fraction of what they previously receive," reads the lawsuit.

SMN offered to modify Busch's payment obligation from $250,000 to $125,000 in 2012, which was accepted by the driver and Kurt Busch Inc. with the 10 percent stipulation through 2018, according to the lawsuit.

The lawsuit claims payments were made under the new terms through the first quarter of 2016 without any issues until Busch terminated his relationship with SMN and "ceased paying SMN altogether from that point forward."

A list of payments included in the lawsuit claims SMN is due $930,450 dating back to March 2016 that has gone unpaid. It also claims SMN is entitled to an additional $540,000 that has not yet been invoiced for the 2018 race season.

Alan Miller, a Birmingham, Michigan-based attorney representing Busch said they will fight against the lawsuit, which includes nine counts such as breach of contract and fraudulent misrepresentation..

"We believe the lawsuit is without merit, and we plan to vigorously defend the lawsuit," he said. He declined any further comment at this time.

My guess? It will be settled out of court with a gag order that prevents either party from discussing the matter. In many cases even if you are right it is cheaper just to make things go away as opposed to litigating to the end.

This will be my only post on the matter. I have no idea if Kurt owes money. He very well could. I do know that the relationship was ended with pretty good cause, and his current agent is one of the best, and has been busy cleaning up many bad deals. Kurt was stiffed several times in his career. Without getting into more detail, just take a look as some of his previous agent's clients, and you might start to connect some dots. Knowing Kurt, I would bet money on a counter-suit over a settlement, and I wouldn't blame him. Having said all that...he really needs to get better at breaking up with people. I get that there's two sides to every story, but something about him must be pretty broken for all these past relationships to constantly drop lawsuits on him. While he might not be "at fault," it's tough to say he's not to blame.

Unless I'm mistaken this makes Harvick the only Stewart-Haas driver not currently involved in a lawsuit.

And DP, its between NB and SHR, but she is a part of it, but not directly like Clint and Kurt , those were direct lawsuits with those drivers, but I get what you are saying, two driver suits and one team suit all from the same organization within a small time frame

Plus there's Tony's ongoing legal issues. Lot of distractions all the way around.

I had missed that. Thanks for the info.

Kurt always seems to have something going on. Hopefully he can channel it all onto the racetrack.

The bad news part is that the agent wants $1.5 million, which is 10% of 2016-18 earnings.

The good news part is that $1.5 million is 10% of $15 million earned in three years...:D

DAMN! I've been around this sport longer than most of you are aged in years and I don't ever remember lawsuits of this magnitude. Back in the day, the big thing was which driver was partying all night, or who was sleeping around, but lawsuits? Few and far between unless I missed the vast majority or they were never discussed. Of course, there wasn't the media coverage then either but even in the garage there was no discussion of this many legal actions taking place. Now we're talking about which drivers / teams are not in litigation compared to which ones are. :idunno:
