As David Gilliland contemplates his immediate future with Robert Yates Racing -- namely whether or not to lose his rookie status in 2007 by taking a Nextel Cup ride now -- sources close to RYR told NASCAR.COM the organization is also in discussion with Jeremy Mayfield about a potential fill-in role in the No. 38 Ford.

QUITE A DAY
All in the space of a day, owner Ray Evernham declared driver Jeremy Mayfield had been terminated, Mayfield sought a preliminary injunction against his firing, and the parties apparently reached a resolution.

Mayfield, released by Evernham Motorsports earlier this week, would only be a temporary fill-in for Yates, and would not sign a multi-year deal.

Sources said Gilliland is expected to man the No. 38 Ford for the final 12 races, but his participation in the fall race at Talladega remains in doubt. He has not yet been approved for racing on NASCAR's superspeedways.

Mayfield's termination from Evernham Motorsports earlier this week opens the seat of the No. 19 Dodge for the current driver of the No. 38 Ford, Elliott Sadler. Sadler may be in the No. 19 before season's end, depending largely on the resolutions of various contractual agreements, sources said.
 
I doubt very much he will be a fill in for anyone.
I wouldn't release him from his contract, just his driving duties. I'd keep paying him, not much he could do about it.
 
I don't know if Mayfield would drive the 38.
If he's planning on a lawsuit with Evernham and he did drive the 38for Yates, wouldn't that mean that he agrees that the Evernham contract was over?
I guess it would depend on his contractual stipulations with Evernham.
 
And people wonder why some drivers don't have any loyalty? Mayfield was screwed by Evernham when they took away his team and it's been downhill since. Nail him to the wall JM :)

That isn't going to happen as the two parties have agreed to work it out outside the courts. It isn't just the owners who do this sort of thing. I think if you would ask Bill Davis what he thinks of Jeff Gordon in this sort of thing, you'd find that it works both ways.

As far as Jeremy goes, I've never thought of him as being anything more than just a so so driver. Probably not much more than Micael Waltrip or Kenny Wallace, but those two have something that Jeremy has never really shown, a great personality that keeps him in the game.
 
Well he has been the un-named driver in the rumor pool for MW #00 BK/Dominos car so I would think he'd just go over there and start putting things together.

That is what i always thought of Jeremy also, just a so so driver. Many organizations have switched teams at the Cup level and had success with it. Kahne has always been the #1 driver at Evernham since Bill stepped down. I think Jeremy is crying way too much, suck it up move on and prove you can really drive for another team. Making the Chase the last 2 years was pretty good for Jeremys' career, but he did absolutely nothing in the Chase once he made it, i believe he finished 10th both years. I think Jeremy is just an average driver at best, of the three drivers Evernham has or had on his teams, Jeremy has the least talent of the 3.
 
Latest on the Mayfield-Evernham legal battle: Jeremy Mayfield's immediate legal challenge to the terms of his firing by Evernham Motorsports has been resolved. Mayfield, who was released Monday, filed the request for an injunction in North Carolina Superior Court in Iredell County. Whether he could have gotten in the #19 car Friday is unclear as Bill Elliott pracaticed and qualified at Watkins Glen International. There was a hearing on the injunction Friday in North Carolina, and the parties had agreed in principle to settle after the hearing, a Dodge spokesman confirmed Friday night. The two sides released a statement Saturday morning: "Jeremy Mayfield, Mayfield Motorsports, Inc., and Evernham Motorsports LLC announced that they have agreed to end their relationship effective immediately. The parties agree that it is in their mutual best interests to go in different directions and wish each other success in the future." Elliott Sadler is expected to take over the #19 car in 2007 but possibly will take over the driving duties soon.(SceneDaily.com), looks like at Michigan next weekend.(8-13-2006)
 
More news on Mayfield: It has been reported that Jeremy Mayfield (released by Ray Evernham Friday) might be in the #38 Robert Yates Racing Ford beginning this week at Michigan. Mayfield certainly seems to be available. However, it appears David Gilliland, who has been working his way through the junior NASCAR ranks, is going to be the choice come next season for Yates and it has also been reported he could step into the car immediately with Elliott Sadler, already reportedly hired by Evernham for the #19 car next season, starting his new job next week [at MIS]. Some have said that Gilliland, who has not been approved for superspeedways including Talladega coming Oct. 8 during The Chase, might want to protect his rookie status for next year. Some in the know have said it’s not his decision but it’s up to Yates as to whether he wants the new kid to run for rookie honors in 2007. Meanwhile, there’s also was the suit filed by Mayfield to try to keep his ride with Evernham. That has allegedly gone through a negotiation and settlement phase and the settlement was reportedly scheduled to be presented to the judge in court in Statesville, N.C., Monday.(Ford Racing)(8-15-2006)
