Judge denies Mayfield's restraining order request

CHARLOTTE, N.C. -- A North Carolina Superior Court judge denied NASCAR owner/driver Jeremy Mayfield's request for a temporary restraining order against NASCAR to have his indefinite suspension for a positive drug test overturned Friday afternoon.

The judge did grant Mayfield's request for a gag order to prevent NASCAR from talking about what drug was involved and set a hearing for a preliminary injunction for Wednesday.

During the hearing Friday, a Mayfield attorney disputed the results of the drug test administered May 1, which Mayfield's attorney said was a positive test for amphetamines. NASCAR's attorney said in court that it was a dangerous illegally banned substance, but did not specify what it was.

Mayfield's legal team argued that Mayfield should have been allowed to have his second sample tested at a different lab than the first test and that the seal on the second sample had been broken prior to the test.

NASCAR indefinitely suspended Mayfield on May 9 over the positive test. NASCAR chairman Brian France indicated May 15 that an indefinite suspension such as the one Mayfield received is for a positive test of performance-enhancing drugs or illegal recreational drugs.

Mayfield denied May 16 that illegal drugs caused the positive test and suggested that a combination of a prescription drug (which in court was revealed today to be Adderall, which is commonly prescribed as a treatment for Attention-Deficit Hyperactivity Disorder) and Claritin-D allergy medicine resulted in the positive test.

Mayfield is the first Sprint Cup driver to be suspended for violating NASCAR's substance-abuse policy since Tim Richmond in 1988 and the first suspended since NASCAR instituted random drug testing this season.

Knowing just enough to get in trouble but IMHO that sample should have been rejected and never tested. I'll bet the judge says the same.

In the previous post(S) about this wasn't it mentioned that there's an ingredient in Claritin that can mimic amphetamines if more than the recommended dose was taken?

So only Jeremy can talk about what drugs he wants to advertise? If he says he only took aspirin... NASCAR can't say one word about what they found in his system.. Is that fair?

Mecklenburg County Superior Court Judge Forrest Bridges set a hearing for Wednesday, saying an immediate ruling was not necessary because Mayfield Motorsports is not racing this weekend. But the judge warned both sides not to discuss Mayfield’s test results in the meantime.
 
Gag order or not the info is out there Amphetamine on the test and Adderall is the prescription he takes

Not necessarily, you're making a huge jump and assumption that
#1 it is Adderall to start with and not something else altogether,
#2 that if that was it he took it as prescribed and didn't decide he was really run down and decided to double or triple dose.

Funny about the gag order though, NASCAR isn't the one talking about the test and the drug in question, it's been Jeremy running their mouth that NASCAR wouldn't tell knowing there is a privacy law and they couldn't. Looks to me like the judge saw through that and gagged both sides.

Just because the lawyer claims the seal was broken, does not mean that it was, these bottom feeders are notorious for throwing smoke screens.

and SST55 why would he take more than the prescribed amount of any drug over the counter or prescribed knowing you can be drug tested at anytime? The fact is if he took 2 or 3 times the amount the directions stated he is guilty of misusing a drug.
 
seems times have changed since i was in college. remember taking vivarin over the counter once. once was more than enough. <g> anybody got a cup of coffee?

All of the above info came from Jeremy's camp! NASCAR hasn't said one word about what he tested positive for. Of course his lawyers know what to say to help their case. I betcha he's out, and out for all time.

Eagle I know I'm taking a hugh leap, I'm actually surprised that it wasn't a leap his attorney made (anyone else see this guy on NN, I am not impressed), which makes it all the more confusing unless of course they did actual amphetamine levels and his was too high for the dose he is on; which of course no one mentioned. :growl:

I wonder what Jon Wood was taking for his ADHD, he was up front with Nascar on his medication usage and that was before all this random testing, maybe Jon would have been suspended too or perhaps Jeremy wasn't proactive and that's the problem. Either way this is just going to get uglier and uglier, JJ Yeley I suggest you ran as far away as you can from this mess.:eek:
