NASCAR Sprint Cup driver Michael Waltrip was involved in a collision with a motorcycle Wednesday evening and was cited by Mooresville police, according to a police report.

Waltrip, who lives in eastern Lincoln County,

Waltrip, 46, who also owns a racing team and is a part-time TV commentator on racing shows, was driving a Lexus that collided with a Harley Davidson shortly before 8 p.m. on Perth Road, according to police. The report says Waltrip was trying to make a U-turn at the time.

The motorcyclist was treated at Lake Norman Regional Medical Center. Waltrip was cited for failure to yield but was not injured.

WCNC-TV, the Observer's news partner, is reporting that Waltrip underwent a field sobriety test after the wreck but passed the test. His alcohol blood level was below the .08 legal limit in North Carolina.

The rider of the motorcycle was Ben Roethlisberger. According to the police report, he was trying to jump his bike over Michael Waltrip's car while yelling "helmets are for losers!"

Minn. man pleads guilty in lounge chair DWI

DULUTH, Minn. -- A northern Minnesota man has pleaded guilty to driving his motorized lounge chair while drunk.

A criminal complaint says 62-year-old Dennis LeRoy Anderson told police he left the Keyboard Lounge in Proctor on his customized La-Z-Boy after drinking eight or nine beers.

Prosecutors say Anderson's blood alcohol content was 0.29, more than three times the legal limit, when he crashed the lounge chair into a parked vehicle in August 2008.

Proctor Deputy Police Chief Troy Foucault says the chair was powered by a converted lawnmower and was equipped with a stereo and cup holders.
 
Now that motorcycle rider knows what the cup guys have to put up with every week. Maybe they should make him do a sobriety test before each race.

If it was Kurt or Kyle Busch, everyone would crucify them.

BTW, crashing in a COT is much safer than having someone run in to you on a motorcycle. Motorcycle riders could be killed in a 30mph impact.

Why? Anyone could have an accident like this. As far as the field sobriety test, it is usually SOP.

That is exactly why I gave up my bike years ago. Too many drivers simply do not see a bike.

Kurt Busch got a whole bunch of crap for getting stopped for DUI (even though he was never convicted:rolleyes:)

Not sure about other areas of the country, but around here in Chicago lots of riders wear cameras mounted on their helmets just for the purpose of a potential court case.

I don't know about in all states but in NC you are not required to take the field sobriety test. And I've been advised by my attorney not to take it. I wouldn't be able to pass it on a good day. Now you cannot decline the Breathalyzer test. You will lose your license. But, if you can talk the cop into it request in your best manners to give blood for testing instead. It is more accurate so if you are drunk you're toast but sometimes the time it takes for them to transport you to a hospital and the nurses take blood is enough time for your BAL to drop.

Not that I have to worry about any of that anyway.

The cops are asking for a Breathalyzer test if one declines they take him ??? somewhere and forcibly take his blood!!
I think our constitution says something about testifying against oneself.. I do not see how the taking of blood against one's will is legal.
I'm all for getting the drunks off of the road.. but I don't think this is a legal means.

They been doing it in Texas for at least 6 months now.
 
Read somewhere that cops with minimal training are drawing blood by the side of the road where whatever infraction took place.
Recent law change here, before if you flunked a Breathalyzer loss of license for a year, refuse and you lost it for 6 months,,,,

I got charged with DUI after passing the field sobriety test and 2 breathalizers(one at the scene, one at the station). Me and the cop had history, we didnt get along. The states attorney dropped it without even telling me. Still shows up on my record and makes me look like a jackass though.
