On October 4, 2005, the National Stock Car Racing Commission heard and considered the appeal of DEI and Michael Waltrip. The appeal pertained to two penalties issued by NASCAR under Section 12-4-A of the Rule Book “Actions detrimental to stock car racing. Inappropriate gesture by the driver during a televised broadcast”. The penalties stemmed from the broadcast of a NASCAR NEXTEL Cup Series event at New Hampshire International Speedway on September 18, 2005.

The penalties assessed were:

• $10,000 fine; loss of 25 NASCAR NEXTEL Cup Driver Championship points; and Probation until December 31, 2005 for driver, Michael Waltrip

• Loss of 25 NASCAR NEXTEL Cup Series Car Owner Championship points for owner, Teresa Earnhardt

The Commission reviewed the broadcast footage numerous times and different Commission members saw different things. Two of the three members found the footage inconclusive. Therefore, by majority vote, the National Stock Car Racing Commission has decided to rescind the penalties. Notwithstanding the outcome of this specific Appeal, the Commission concurs with NASCAR’s strong stance regarding inappropriate gestures and/or language during NASCAR broadcasts, and the need for vigorous penalties for any infractions.
 
He appealed an unecessary fine. NASCAR said he gave the bird when he clearly did not. Case closed.
 
Even if he did give the bird. So what? He was in his car, not on pit road being interviewed. Cripes! Can't a guy flip a driver off without getting fined?
They want robots to drive in circles and do nothing but politely thank sponsors. :rolleyes:

Watch any coach in the NFL on the sidelines during a game. If you can read lips you'll see that they aint reciting the bible.
That's not scrutinized, why should a driver fliping a guy the bird, while still in his car I might add, be any different.
 
Here is a case of the untouchable Mikey, poster boy for Nascar getting a break he does not deserve. I like Mikey, think he is funny, rather ubnoxious at times, but entertaining. Still, this has to piss of a lot of drivers.....i don't think it is fair.
 
I am lost here. NASCAR fined and docked points for an inappropriate gesture shown on National Television that I and the commission did not see. Why would the drivers be pissed off????????? They did not fine him for turning Robby!!!!!!!!

How is he untouchable? He did not flipp anyone off. He may have wrecked someone under caution, but thats not what the fine was for. If the camera showed the flipping the fine would still be there. So your statement is total :bsflag:


BTW I don't like him at all but fair is fair. ;)

Don't know why you think other drivers would be pissed off. He didn't flip anyone off, therefore, no reason to fine him. Each and every one of the drivers have received "special" treatment from time to time---they love it when they are getting it, hate it when someone else is getting it...and if the damn cameras were taken out of the cars, we would never "see" a thing Nascar can gripe about, AND since the cameras are there the networks and Nascar need to suck it up as they are the ones responsible for what is seen on tv.
 
Yeh ok ...... camara did not catch him flipping anyone off, specifically R. Gordon, doesn't mean he didn't do it. Mikey acts like he is mr. goody two shoes....well he isn't. You have your opinion Bucky and i have mine. :cool:
