NASCAR files countersuit against Mayfield

They should just try this case under the BIG Top at Barnum and Bailey cause this one is turning into a circus.
 
Is it just me, or has NASCAR in many ways been in the courts a lot in the last couple of years?
 
I wish they would just settle out of court but I'm not sure that can happen without setting a precedent that Nascar doesn't want to set. This is just a mess and getting messier, I'm guessing Nascar is trying to push the pricetag up so high that Mayfield can't afford to play anymore.

No I think what it boils down to is; if NASCAR doesn't vigorously defend the drug testing policy and have it settled in black and white with NO grey area from a court of law, what chance would they ever have of enforcing it?

There can be no settling out of court, Mayfield's lawyer should be smart enough to know that.

David vs Goliath, Na$car can outspend Mayfield till the cows come home. Suits and countersuits will be in the court system for years, if not a decade+
 
The entire situation

revolves around that evil third drug! MAyfield is trying to protect his good name without mentioning that drug.. But NASCAR isn't having any of it.

"NASCAR’s attorney, Paul Hendrick, said three drugs were found in Mayfield’s system from the Richmond test. Two of the three were Claritin-D and Adderall-XR and the third, Hendrick said, was a “dangerous, illegal, banned” ".

Until that drug is named none of us will ahve any real understanding of what is going on.

NASCAR has fired back with its own lawsuit against Jeremy Mayfield who has been suspended since a positive drug test.

The lawsuit is 49 pages defending NASCAR.

Most startling: The claim that Jeremy Mayfield knowingly put people in danger.

“Had we known things previously we wouldn't have allowed him to race," says Ramsey Poston,

NASCAR’s Communications Director.

The suit points to Mayfield's driving record on the track saying he had 3 accidents in 5 Sprint Cup races this season.



Accidents, NASCAR says, happened during the same time he tested positive for an illegal drug.

The name of that drug, and its street name, is being hidden in the suit.

NewsChannel 36 asked NASCAR why?

"We're honoring the state court's order," says Poston.

Mayfield says he was taking Adderal for Adult Attention Deficit Disorder and Claritin-D for allergies.

But the lawsuit claims he was taking an illegal drug that can fight fatigue, keep you alert, and produce a sense of euphoria.

The suit says it can also cause insomnia, high blood pressure and paranoia.

NASCAR also says Mayfield knew about its drug policy and even signed an agreement to notify doctors about any prescription drugs he took.

He didn't do that until he was tested.

The suit also claims Mayfield defrauded NASCAR and other competitors by accepting $150,000 in winnings for two races, in which, he admits using the undisclosed drug.

"He took a spot that another racer could have had and had those earnings," says Poston.

The suit is not seeking monetary damages right now.

But a NASCAR representative says it's possible they'll look to get that money back as things progress in the case.

Exactly. And considering Dumb Ass changes his story every week:rolleyes:, at this point, I'm believing NASCAR.
 
I'm not condoning anything if Jeremy was really taking meth, but I have to wonder since as stated above, the decongestant in Clartin D is what has been used to make crystal meth and Adderall is an amphetamine, which apparently is OK if it's prescribed and reported to NASCAR? I'm sort of confused about all this really.

It Jeremy was really doing meth, he's really got to be strung out or something to make such a fuss and challenge NASCAR. On the other hand, he was taking 2 medications that produce affects similiar to meth. Weird.

I'm not convinced.........Why would Nascar counter suit when they needn't....other than to scare Mayfield.

The ingredients in his prescription are used to make meth.......so I'm willing to give Mayfield the benefit of the doubt......and why would he fight it ...if the facts just prove him wrong?

not saying jeremy is right or wrong but never underestimate the stupidity of people.
 
Now the gloves are off!

A third drug came up positive during the urine-based Richmond test and had not been previously identified. The name of the drug in question has been redacted from court documents and was not specified by either Mayfield or NASCAR because of the conditions of a May 29 gag order issued by Mecklenburg Count Superior Court in North Carolina, according to the publication.

The magazine learned from sources that the unidentified drug was methamphetamine. Neither NASCAR nor Mayfield is allowed to comment because of the gag order.

Mayfield's attorneys argue it was a false positive test reading, triggered by either a mixture of the two acknowledged drugs ingested or by poorly executed testing procedures.

I believe that it will be revealed that other components of methamphetamine were present in the test and that other components of Claritin-D and Adderall were not.
 
Well either way Nascar needs to make public their banned substance list. As it is usually par for the course when it comes to Nascar, they have been very secretive when it comes to their drug policy. They should adopt the same policy that Formula 1 has.
 
I still have to wonder why we need to know what NASCAR's list is. :confused: Their list doesn't affect us in the least. :beerbang:

In addition to that, he put his own life in danger as well. The most dangerous thing about meth, according to experts, is a dramatic rise in body temperature, blood pressure and heart rate. Combine that with what a driver's body goes through over the course of a race (the temp in those cars is ungodly high) and he could have easily killed himself and many others. Killing himself would have been sad, but another case of natural selection (the weakest and dumbest of the species begin killed off first). It would have been a real tragedy if he took innocent others with him.

On the other side of it, if it does turn out to be nothing more than a combination of the two legit meds he was taking, I can see a huge lawsuit. Not so much against NASCAR, but against ESPN for defamation of character.

One thing I've noticed, is that apparently Jeremy didn't bother to tell NASCAR he was taking a prescription drug as required by the agreement he signed at the beginning of the season.
 
Here's the deal. Either Mayfield did what he said he did and took 2 Claritan D pills or he's into something he shouldn't be in. The testing company will have the last say on this. But I'm not sure even they can determine if that's all he took or is on something else.

Good point, I always thought Jeremy was a little full of himself, but a decent driver. I hope for his sake that he didn't do meth and for Nascars' sake too, afterall it would tarnish the sport ....:sarcasm:

Aint that a fact..........it doesnt look good for Jeremy. His re-emergence in the sport didnt last long.......and now his name may go down in infamy
 
Looks like Mayfield has changed his story a time or two.

UPDATE: Suspended for failing a drug test, driver Jeremy Mayfield said he "inhaled fumes from a fiery wreck in the Talledega race," according to more court papers filed in the battle between Mayfield and NASCAR. Mayfield was indefinitely suspended May 9 for failing a random drug test conducted May 1 at Richmond International Raceway. He filed suit to overturn his suspension on May 29. In legal papers obtained Monday, a response by NASCAR drug testing firm Aegis Labs said a doctor asked Mayfield if he had taken any diet medications or inhalers, specifically, Vick’s Inhaler. Mayfield said he had not, the papers say. Doctors said in the documents that they agreed with Mayfield's account from an earlier suit that in a subsequent phone call Mayfield said "he was in a fiery wreck while competing in the Talledega race in late April .... and inhaled a large amount of fumes." The Talledega race was in late April, prior to Richmond.(Charlotte Observer)(6-10-2009)

I'm sure some of the stuff we are getting is delayed. And some could of been out before but we just now are getting it. I think the fuem deal is pretty stupid. But before we hang Mr. Mayfiled lets see what the judge says and everything.

Anyone seen a new pic of Mayfiled? Pretty easy to tell if someone is strung out on Meth, by looking at there face and teeth
