Shouldn't be long before we hear. Then the bashing can begin in earnest!! :D

Watch your wrists, Tony, they're fixing to get slapped.

I think his behavior everywehere is unacceptable. Maybe they should just get rid of him, he spun out 3 people sunday

I don't think anything should be done to Stewart. Vickers didn't get hurt. In order to committ assualt, bodily harm must be done. He probably didn't even have a mark. But given his history, everything he does is magnified 100 times.

Kevin Harvick said that they told him that his past help deside the 25 grand he got fined. Tony has pretty good past himself.

I'm with coonhound..............let it go. And for Tony spinning three cars out last Sunday..........what I saw each incident was just plain hard racing. But, NASCAR will do what they think is best..........not what we think is best. :D

don't you just love the "magic rule" of Actions Detrimental to Stock Car Racing (ie: anything)

Where is fergy when you need him! I don't know what state you live in, but in the state of Texas, a person does NOT have to be injured to be able to file an assault charge against another. I like Tony, but he made a mistake. AGAIN! And, this was a big one. I do not intend to bash him or anyone else, but I don't think it was necessary to say that Brian Vickers is a wuss either!

***off of soapbox now*** ;)

So it is alright to hit a somebody as long as it isn't with a closed fist. If Vickers crew wasn't there, how far would have Tony gone.

Spencer got suspended, and Busch had it coming.

Everyone's acting as if NASCAR isn't going to do anything.......premature, I think. :)

Ol' Stewart is mowing those Hendrick drivers down one by one.

J.J. better watch out - that's if Stewart will be racing this weekend.

As to any possible charge I have to agree with maj. With assault you only have to show that the person intended to do harm or violence and had to means to do so. Battery is when you do harm or violence. Actually, just grabbing someone by the arm could be construed as assault. NASCAR is really up against it on this one. How much stroke do sponsors have? Will Home Depot take any actions?

The amusing start of a sentence of the article linked was
Vickers was knocked out...
I won't say in what context but it did strike me as funny.

It is just my opinion, but Tony should be suspended at least one race. They have done everything short of suspending Tony before and it obviously hasn't worked. Tony has an immature propensity for violence and temper tantrum throwing that he seems to be unable or unwilling to control.

I respect Tony as a driver and I know and like many of his fans, but Tony needs to get himself under control or NASCAR needs to do it for him. He has had plenty of chances to do it himself and he has chosen not to do so.

This is of course just my opinion, your mileage may vary. ;)

I still find it amusing that people are trying to find ways to defend/justify Tony's actions. It's a fact that the guy can be hot-headed at times. From his rookie year on there has almost always been some sort of antics from him. He's one heck of a driver, but now, he's hurting himself, his team and surely must be driving Home Depot nuts.

The precedent has already been set with the suspension of Jimmy Spencer. Provoked or not, you just can't do what Tony did and not expect there to be some sort of ramifications. If I walked up to someone sitting in their car and put my hands on them, I would surely be escorted away in cuffs.

As far as the number of cars he turned around during the race, there is a difference between hard racing and reckless racing. He's really starting to look more on the reckless side. He's good enough o make passes without having to turn someone around, so why doesn't he?

Bodily harm is not a prerequisite for Assault. Assault charges may be filed for verbal threats. The key component is whether the alleged victim is placed in a situation in which a reasonable person would be in fear for their safety. If I threaten to clean Harvick's clock, for example, that could be construed as assault if it were proven that I had the means and access to make good on the threat. Tony had both in the situation in question. A reasonable person could and should conclude that being accosted while inside a race car, still strapped in, and then struck in the chest with sufficient force as to knock the wind out of the alleged victim while a verbal exchange similar to the one reported occurred would satisfy the legal standard of assault in most states.

But none of that will matter. Tony will pay a little fine and be put on double secret probation for some period of time and that'll be that and NASCAR will watch those TV rating soar.

As to Tony's history, his reputation as a hothead is well documented and well deserved.
