OK can someone please explain to me whats going on with the number 28? Last word I got was that Havoline owns the rights to the number & will not allow RYR to use it with another sponsor. How is that possible, the number belonged to that race team well before Havoline came on board & I thought NASCAR had final say on who doe's what with the numbers. Don't they rent them out to the owners at the start of every season? School me please cause I wanna see #28 back on track...
 
I don't know much, but I thought NASCAR owns the numbers and the teams lease them.

NASCAR owns and assigns car numbers to an owner(s). NASCAR reserves the right to revoke or transfer car numbers to another owner/team at any time. Car numbers are non-assignable and non-transferable, except by NASCAR. NASCAR works with teams and sponsors when a specific number is requested. If duplication of numbers occur, which usually happens with the part-time teams, the fastest qualifier usually gets to use the number unless one team is considered full-time. In 2002, the #27 was used by Scott Wimmer for Bill Davis Racing and by Kirk Shelmerdine, both part time, however, Wimmer was listed in the #27 and Shelmerdine in the #`172 and when they attempted the same races, Wimmer got to use the #27 and Shelmerdine ran the #72, so NASCAR uses it's judgement in deciding who runs the number.(9-6-1999/9-17/2003)
 
NASCAR Does own the #'s. You can bet your bottom if Haviline owned the #, Chip Gannassi's car would be #28 and not 42.

I'm not sure if RYR is holding the # with NASCAR's permission or if no one has opted to use it. There is an awful lot of bad luck connected with that #.

I remember Ricky Rudd wanted to use the #28 and somebody refused to let him. I don't remember who it was though.

The agreement, sources said, was that RYR could keep the No. 28 when Texaco left for Chip Ganassi Racing, but that Yates would wait several years to run the number.

Yates and Masterfoods -- Snickers' parent company -- wanted to run the No. 28, but couldn't reach the required agreement with Texaco to do so, sources said.
 
The #28 is haunted.

Rudd drove the No. 28 for Yates from 2000 through 2002, posting three wins and 34 top-five finishes.
If it's haunted then some other drivers **cough Carl Edwards cough** needs to have their cars haunted...

I don't know how I feel about that. The 28 still reminds me of Davey. Do you want anyone else to use the #3?
 
naw, I don't but Davey wasn't the last driver to run that number. I dunno, maybe it IS better to keep it in the vault. I wouldn't wanna see it on the side of one of these COT cars anyway...
