Roush Racing appeals penalty

Roush Racing has appealed the penalty levied against the #6 team following the Rockingham race.

Roush Racing has also stated that the will NOT pursue any legal actions against the spring manufacturer.

Roush Racing president Geoff Smith cited section 12-4 of the NASCAR rule book as grounds for the appeal.

"According to NASCAR rules (sec. 12-4), penalties for violation of NASCAR rules are determined by the gravity of the violation and its effects of fairness of competition," Smith said.

"Since the spring in question had an inconsequential deviation from the rule-specified length, since its use had absolutely no effect on the fairness of competition, and since the penalty imposed was harsher that the intent of its own published standards for the imposition of penalties, we have elected to take advantage of the review process NASCAR has provided to us."
 
If he is more than 25pointsd behind after Sunday it wont matter one way or the other. But if he 25 or below then it would get interesting.
 
As strange as this season has been I could see Mark losing by less then 25 points and they the penalty gets reversed and then he is crowned as the champ.
 
I'm not sure who Roush thinks he is fooling with saying they are not going to sue.

They just said about a week ago that their lawyers told em to appeal, so that they have more evidence in their lawsuit.
 
Roush doesn't want to be labeled a cheater, even if these 25 points don't have any effect in the championship hunt. He's got the right to appeal, why not take it?
 
Formalities. Saving face in the eyes of fans. Not much else he CAN do really.

He'll lose. I don't see how NASCAR can go back on an illegal spring. Penalty doesn't need changed, it was fair, get caught pay the price. Mark will finish second again.
 
When you look at the history of appeals, I don't think they stand a chance for getting a turn around decision. At this stage of the game, I don't think they will get a reduction in peanalty points either. Like Ciggie said, they got caught, they pay the price. The other thing that looms largely against them is the fact that Matt Borland said they didn't bother to check the spring before they put it in. OOPS, they admitted they messed up. If you want to play, sometimes you got to pay.
 
I think if nascar backs down then more racers might do it, thinking they can just appeal and win back the penalty.
 
It was their responsibility to check those springs before they went in the car, especially when they know that's a piece NASCAR pays particular attention to. Roush knows the odds he's going against, but he'd be stupid not to appeal since he can.
 
If Jack loses his appeal to NASCAR and takes it to a civil court, it opens the door for a lot of crap that might lead to some compromising dicisions by all sorts of outsiders. I can understand how Jack feels, but I think that if Big Jim were still around, he might be able to work it out with Jack.

Well Bill didn't brook much interfernce with the way he wanted to run things. Didn't much matter who ya were. Just ask Curtis or Richard. If nothing else Bill commanded respect.

I have a feeling from little bits we hear, that fans might be surprised just how much the competitors respect Mr. Helton as well. They might not agree with him, some days they might not like him, but I do believe they respect him.
 
Duh, I'm gettin old too, and yes, I did mean Big Bill. I read an interesting piece from Larry McReynalds new book about what happened to him when he began to gripe too much. It sort of followed this line of thinking.

Thanks all for the welcome. I may be new here, but I've been watchin', writin', gripin' and dreamin' about racin' for a long time. I hope I've found a great place to exchange ideas.

Yep, them there roastin ears are great. My wife made that picture and took it to work. I told her to make sure she told them she married that rascal!
 
imo nascar would be foolish not to reverse it's decision at the apeal hearing. They have a chance to save their face and their ahem at the same time, and imo would do well to take it.
