Am I wrong to think that the performance of the owner was not too convincing? I may be wrong but I voted that the owners are too blame.
 
From what i have read, they were in the process of selling the club this week, sounds kind of fishy to me. So i say the owners.
 
Apparently, Great White played at a club in Jersey a few days before. They didn't say anything to the owner of that clubs about the pyro, and when it went off, he told them to shut it down. The lead singer keeps saying that he had permission to use the pyro, but hasn't said who he got it from.

Even if they did have permission, I'm sure they have to set the pyro up in consideration to the building that they are performing in. Sounds like a bad logistical mistake.
 
I say all had something to do with this. Even perhaps the state who is responsible for check establishments like this. But given the choices in the poll, I say the band is responsible.

Great White is the one who had the pyro's. Great White is the one's who chose to use them. Great White should be responsible for their actions.
 
They both should have known better than to set of the pyro display inside. this is history repeating itself again. the curtains were not flame resistant as you can see in the video. the owner should have known this and the band should have checked first. this is absolutly an avoidable tragedy that never should have happened. I am sure there was no intent on either part, but there was a definate lack of responsibility on BOTH parts.
 
I picked the owners. Assumeing the band told the owners they were going to use them.
 
Ultimately, it falls to the club owner. It's his property, he controls what happens on it.
 
Gotta say the band on this one. There have been reports of Great White using pyro's on several occasions where they either never recieved permission or were even denied permission to use them over the past few months.
 
The owner should have checked the stage before the band went on --- especially since Great White is know to use pyro-technics. If the owner denied permission, HE should have followed through and made sure.
 
How is it the owners fault if they didn't follow his instructions? Is it then the polices fault when someone breaks the law bacuase they weren't able to prevent them from doing so?
 
OK, so if I come to your house, ask your permission to do something, you OK it, and someone gets hurt, who pays? Your homeowners insurance. Thus, your liability.

I studied the business end of the recording industry in college. Started as my major in fact. Nearly every performance contract at that level (clubs) plainly states what is and what is not permitted. It also states that the final call lies with the club owner as they carry the liability insurance. They have a business license to protect. If a performer is hired to provide entertainment, they do so under the club's terms. Therefore, anything that a club owner allows in his club is on his head if it goes bad. At least, that's what they taught us.

I agree with you TWF i am in the process of starting my own business and it is up to the person who owns the business to carry the liability insurance. In this case that is the club owner, which is why i said earlier in this thread that the club was in the process of changing hands, which most likely contributed to the lack of responsibilty on the clubs end of the deal. They should of checked what Great White was going to use in their Pyro show before they started it. Bottom line is Great White got away with doing something that should have never been approved in the first place. As a result a lot of people lost their lives... truly tragic and inexcuseable!
 
the way i see it...

its the bands for seting up the pryo that close to the curton or what ever caought on fire 1st.

the owners for not checking it and makeing sure it was set up in a safty way, or should have tested it 1st and see how far the spark shoots out. or just said we will not take that rish with pyros.

i mean they could make made napal and set in on a pise or metle on the stange, just dont step on it. :p
 
I doubt that something of this magnitude will be on VH-1s "Where are They Now". The Owners are clearly at fault for allowing the band to do this, they are liable first, the band second, when all is saidand done, more than 1 person will go to jail. To say that the band Great White is done as a band would be an understatement, they will never play again. Too bad, but ignorance concerning something that puts lives at risk usually results in a bad outcome.
