Custody battle

We recieved a letter in the mail today from my girlfriends exhusbands lawyer that says he wants to persue custody of the kids. Boy did this turn my house upside down. She has custody and he has visitation rights in the summer. We are supposed to go down and pick the kids up on 8/17. He says if we show up, he'll call the sherif on us. Our lawyer says he can not prevent us from picking them up without a court order. We really can not afford an expensive attorney. Guess we are going to have to tighten our belts and go into debt.

LOL, I have to laugh at the fact that the ex said he would call the sheriff on YOU GUYS. Since SHE has custody!! I would go down there and tell him to go ahead and call the sheriff so that he can be carted away in handcuffs while you guys take the kids back home..... If he tried to prevent her from taking her children that she has custody of back home, HE can go to jail for kidnapping and failing to follow a court order....of course all of this is providing their custody arrangement is court ordered and not just something that the 2 of them set up themselves....

Yeah, It's court ordered. Infact, he was served the papers while he was sitting in jail for beating my girlfriend. I thought much of the same thing about kidnapping, but I do not really know how different states handle things. They live in West Virgina and we live in Ohio.
 
Different states do have different laws, but a court order is a court order. I would simply call the sheriff of the town that he lives in and explain the situation before you go down. They might even be willing to escort you to the house, just be sure to have the court papers with you.
