DEI Statement/Appeal: Dale Earnhardt, Inc. announced today that the #8 Budweiser eam that fields Chevrolet Monte Carlos for Dale Earnhardt, Jr. in the Nextel Cup Series, will appeal the NASCAR-imposed post-race penalty that cost the team 25 championship points and $10,000. Richie Gilmore, DEI Director of Competition, cites that the 25- point penalty under the new 10-race “Chase for the Nextel Cup” format could be devastating with only seven races remaining. “This is a huge setback for the entire company,” Gilmore said. “We’re in a sport that focuses its primary attention on the final 10 races of the season and we’re racing against formidable teams for a championship. We’re facing a setback from a competition standpoint for something that should be considered a personal foul. We have no choice but to appeal the points portion of the penalty. I think we’re the only sport that takes points off of the board after they’ve been scored. The popularity of this sport is based on colorful personalities and the fact that everyone can relate to these drivers and their emotions. Now, it seems like that’s a detriment. Dale Jr.’s comment was made in the excitement of the moment, seconds after he climbed out of the car. It wasn’t made in anger or hostility directed at anyone. This whole incident is going to force everyone in the sport to rethink showing any excitement in what should be a jubilant moment. We’ve had hundreds of calls from fans that support us. Our sponsors have vowed their support, as well. If nothing else, we can look back at this race and always remember it as one where we were reminded of the loyalty everyone has toward Dale Jr., the No. 8 team and our company.”(DEI Site)(10-5-2004)

I'm predicting a reinstatement of the points and the fine stays or gets higher.

Guess we'll see how important credibility is now
 
Hey guys, go check out the cartoon of the day on Jayski. It's a spoof of the Enterprise commercials Jr. does. It's off color so I'm not sure it would get posted on here but I almost fell out of my chair laughing. Then again I like the Saturday Night Live skit type of humor so some folks might not find it as funny as I do.
 
I am all for the "appeals" section of any judgemental ruling or sentencing;
But................the crime was heard on nation wide TV and no one can dispute that he did or did not do it.

The fine and penalties as mandated and already established by NASCAR on Johnny Sauter and Ron Hornaday should not be changed because of a sponsor name or driver name.

I'll just bet Jr wishes he could have bitten his tongue off right after his fauz pas!!!!!

That's another example of putting mouth in gear before engaging brain.

Let the fine/penalty stand!!!!!!!!!!!!!!!!!!!!!!!!!

Not at all. I'd appeal it too.

If they relent and back off the points deduction, all y'all Earnhies better duck and cover cuz you know it'll be coming. And you also know it'll be deserved.
 
So when was the last time Nascar granted an appeal?? I don't believe that the PTB will overturn their decission.

I got my hardhat and safety glasses ready. B) Personally, a rule is a rule and he got what he deserved. But I also can't blame them for appealing. :)
 
Nobody can blame DEI for appealing. But I think Nascar should stick to their guns. :cheers:
 
As I'm pretty sure they will, Gollum. I don't know of any recent (last 2-3 yrs) fines/penalties that have been overturned by Nascar.
 
Some of you people really crack me up...of course some of you people make me wonder if you need some kind of help... ;)

Its a given.... any team, and driver, any anything...doesn't matter if its racing, baseball, football or twiddley winks, if a player gets hit with any kind of fine or suspension, an automatic appeal letter is presented.

NASCAR hasn't reduced any kind of penaly it has ever dished out, other than Stewy's "probabtion". And they won't start now.

Jr got fined and docked points.....go back to complaining about the special plate, secret areodynamic paint, super light-weight decals, flexible fenders, super-polymer front bumper, and self-adjusting spoiler. :D

NASCAR has commissioned me to teach them consistency. So far, it seems to be working.
 
No, I work cheap. All I need is what drops off Helton's plate and I can feed my family of 31 just fine.

I hope that NASCAR dosnt repeal it just because they are DEI. I thnk they deserve also becuase al all that dale jr. ahs done in the past
 
NASCAR has already done the right thing,They should just now stick to Their original sentences. ;)

Questions to ALL?????

Take the fact that we are talking about Dale Jr. and forget it.... Do you actually think NASCAR should determine whom wins it's Championship by their none racing actions before or after a race???

What happens when we get to the last race and the Championships Winner lets one fly...and 2nd place lets one fly....and 3rd...and 4th...all the way to number 10.... Does someone whom was not even in the championship race win the CUP or not give it to anyone..????

What about Drivers that are caught on camera cussing when the audio is not heard.. We all know what they said.... Should we take points away for that?? How about the water boy for the team what if he lets one go....???

Come on.. you have to admit.. this is....WRONG....
 
I do not like the fact that drivers can't speak their mind. NASCAR was pretty much forced by higher powers to enforce the cursing rule. Now that it is in place NASCAR must be consistent or lose more credability.

Remember when Mike Wallace wrecked and got out of his car way out in the grass????? No mics around him, but a camera zooooooomed in on his face full of anger at himself. He used the "F" word. AND HE WAS FINED!!!!!!!!!!!!!

Wasn't heard on the telly, but it was sure seen from coast to coast!!!
So we really have 3 that have been reciepients of the NASCAR "word" rule.

Fair is fair. The deed is done.

Let's start looking forward to how Jr is gonna make up the 25 points that really aren't hurting him that much.He is still solidly in contention for the Championship!!!!!

This is really getting funny!! :D NASCAR did what many of you wanted and took points from Jr. Now you are acting paronoid about NASCAR changing their mind!! Tell me how many times has NASCAR reversed itself on any penalty they have given out!! Jr got what a lot of you think he deserved...........why not let it go? Are you afraid your conspiracy stuff will suddenly be gone? Be happy, you got what you wanted...........and believe me it won't be reversed. Just rejoice. You're wrong DE, that is not what they all wanted. They wanted Nascar to slap Jr on the wrist and tell him don't do that again. They wanted the inconsistency, so they would have something to complain about. At this rate nobody will have anything to bitch about next year.
 
Point of information of the appeal's process....

NASCAR.com

* A written request for an appeal must be made to the National Stock Car Racing Commission within 10 calendar days of the notice of the penalty.


* The chairman of the National Stock Car Racing Commission will set a date and location.


* From the pool of 31 commission members, the chairman will be joined by a minimum of two to constitute a quorum. Commission members are selected based on their knowledge and experience. They include men and women from a variety of motorsports backgrounds, some active in the sport and some retired. They include promoters, industry leaders, and dignitaries from other forms of professional motorsports.


* Appeal would be heard; decision handed down.


* If the team is not satisfied with the decision, they could make a final appeal to the National Stock Car Racing Commissioner Charles D. Strang. All decisions by the commissioner are final.
 
If NASCAR gives Jr his 25 points back, then they should give Jamie McMurray his 25 points back and put him in the Chase. It's only fair.

I am by no means a Junior fan, but i see DEI's point here. Sure a precident was set with Sauter and Hornaday, but when they got their points taken away, they were not in the same chase for the cup senario. Since they are not in the same situation, then the same precident does not neccisarily apply.

also, someone stated that nascar is the only sport to take away points after they are earned. example, would be a football celebration after a toutchdown. the penalty doesnt take 2 points away from the touchdown, it awards the full touchdown and puts the penalty onto the next play. I think this would be good for Nascar too. How about having the team start 5 spots lower than their qualifying position, or maybe 10 spots, or even have them start dead last. plus they could get last pick for pit stall, and have to qualify first. basically i think it is a bad idea to take away what is already earned. you can still award a penalty to a team, without deducting points.

like i said, i am by no means a fan of juniors, but i think DEI made a good point. At first I was even hoping that Jr. would lose points because i thought it only fair if Sauter and Hornaday did. But, they make a pretty convincing point. Besides, like they said, if the penalty is going to be so severe in this Chase for the Championship, then you end up seeing a lot of boring personalities in Nascar, due to everyone being in fear of costing their team the Cup.

What am I griping about? I'm just saying... be fair. Johnny Sauter said it best...

"I don't think there's any validity to that," Sauter said. "If you say a cuss word, it doesn't matter what your intention is -- it's still a cuss word (and) it's still heard by millions of people.

"If you let a word slip when you're happy, or you say something you shouldn't when you're upset, it's still the same word (and) if someone's going to be offended by it, they won't care why you said it."

Fined Drivers Agree with Earnhardt Jr's punishment.

No, no, no. The example is not football. The rules of football does not provide for the deduction of points for wrong doing. NASCAR does. It's not that hard to figure out people. He violated the rules and NASCAR had the balls, which I admit I didn't think they had, to hold Lil'E to the SAME standards as everyone else.
