Did Mayfield know what gave him his positive result?

DB – I read a report where Mr. France gratuitously announced that the serious recreational drug use by Mr. Mayfield was very difficult, very bad. Accusing somebody that’s driving a racecar a couple hundred miles an hour of serious recreational drug use, that’s probably not a very good thing to say about him. Especially if it’s not true.


WOW! This alone could be a bonanza for Mayfield. That is slander unless Brian France can prove Jeremy has a serious recreational drug use problem. If Jeremy isn't reinstated by NASCAR, I see a slander law suit against Brian France personally and against NASCAR as Brian France being their representative. That could easily be what Mayfield needs to make the suspension (an potential law suit for slander) go away.

The problem I see with that statement by the lawyer is that it is incorrect and the context is twisted to sound good for them.

The actual quote;
NASCAR chairman Brian France on Friday said Mayfield tested positive for a "serious infraction," defining serious as performance-enhancing or recreational drugs.

so IMHO getting this statement from the above is a REAL stretch;

I also read some place that some "anonymous" source said that performance enhancing drugs had been ruled out, IMPLYING, that it was recreational drugs, but it was NOT Brian France that said that.

So in my opinion they're still pissing in the wind implying lawsuits.


IMHO if they have a case file it and be done with it, but I do not believe they have a winning case.

NASCAR is not in reality preventing Jeremy from making a living, he is a race car driver he can race in any other sanctioning body he chooses.
NASCAR is a privately owned business and they can set the rules and guidelines and disqualify anyone that does not follow them.

I agree with you. That lawyer has a history of playing the media and that's all he's doing. He is trying to play on the public's opinion. :beerbang:
 
If Mayfield is serious he, or his lawyer, has to make the results public for all to see. His doc has to say what was legally prescribed and what combination of drugs Mayfield took. Get rid of the he said, he said inneundo and dance around words. Present the FACTS of the test results and manner in which the test was conducted.

Imagine this, suppose the machine malfunctioned and the makers of Claritin put a wee bit too much of something in that batch. Don't say it can't happen, it does.

Or imagine this..... Maybe it has nothing to do with Claritin D at all and he was simply doing recreational drugs like what has been implied? :beerbang:

Very true. Until all the facts come out it's just speculation.
