Defending NASCAR Nextel Cup champion Kurt Busch was issued a criminal traffic citation for reckless driving Friday night by a Maricopa County Sheriff's Department deputy. The stop occurred at 8:20 p.m. near El Mirage Road and Broadway. A spokesman for the Sheriff's Office said that the officer on the scene deteteced an “odor of alcohol,” and tried to admininster a standard field sobriety test but Busch refused to take it. He was then taken into custody under suspicion of driving under the influence. At PIR, the spokesman said, the breath-alcohol machine malfuntioned. Busch, who will drive in Sunday''s Checker Auto Parts 500 at PIR, was ordered to appear in Tolleson Justice Court on Dec. 22. Jim Hunter, NASCAR's vice president of corporate communications, said, the organization has “conversations with our drivers about conduct, yes.”(Arizona Republic)(11-12-2005)

You know I think its about time he got charged with reckless driving. He's been driving reckless on the track for years now :)
 
as always he got lucky with the mechiane messing up. but they should of had him pee in a cup. But if an cop smells alcohol on you and you refuse to take the test you are auto guilty.

Here in California if you refuse a blood, breath or urine test, you automatically loose your license for 1 year. As far as feild sobriety tests go I'm unsure. I get this feeling that the local police felt that they should charge him with whatever they possibly could. and didn't pursue a DUI knowing full well he can afford all the lawyers in the world. Kinda sick in my opinion, because if were just one of us average people we would go down.
After what he has pulled on Jack rousch ( the guy who made him what he is ) I say way to go Kurt, What comes around goes around.

Busch was stopped Friday night after trying to avoid another car and running a stop sign about 2 miles from Phoenix International Raceway, said Lt. Paul Chagolla

Chagolla said the deputy smelled alcohol on Busch, but the driver refused to perform standard field sobriety tests. Busch did submit to a field breath alcohol test, and the device showed the presence of alcohol.

The deputy drove Busch to the raceway, where a sheriff's facility is located, to administer another breath test but the machine there failed. The deputy then decided to cite Busch for reckless driving and he was released, Chagolla said.

Down here in Texas if you refuse to take the test they take your license for a year... BUT you do not get a DWI. If you take the test and fail all hell breaks loose. You get a record, lose the license for the SAME year, And whatever community service or jail time the judge can think of to boot! So if you have had even ONE DRINK... don't take any sobriety test.

A policeman pulls over a driver for swerving in and out of lanes on the highway. He tells the guy to blow a breath into a breathalyzer.

"I can't do that, officer."

"Why not?"

"Because I'm an asthmatic. I could get an asthma attack if I blow into that tube."

"Okay, we'll just get a urine sample down at the station."

"Can't do that either, officer."

"Why not?"

"Because I'm a diabetic. I could get low blood sugar if I pee in a cup."

Kurt's Defense:

A drunken man was wondering around the parking lot of a bar, bumping into then rubbing the roofs of the cars. The manager comes out of the bar and stops the guy.

"What the heck are you doing ?" he asks the drunk.

"I'm looking for my car, and I can't find it." he replies.

"So how does feeling the roof help you ?" asks the puzzled manager.

"well," replies the drunk earnestly, "MY car has two blue lights and a siren on the roof!"
 
Kurt Busch issued a statement saying it had nothing to do with alcohol... who does he think he's foolin'?
 
It was previously said in this thread that what goes around comes around, i believe in that Karma stuff. Just like that show Earl that is on tv.....lol. No seriously he has been acting like his ---- doesn't stink for along time now, his little brother isn't much different. Maybe Jack wanted him to go? Maybe he saw what an ass he really is.
 
I say big deal to the whole story.
The presence of alcohol odor and being legally drunk are two different things.
I have several cop friends that all say if you can pass the FST they'll let you go.
 
UPDATE: NASCAR president Mike Helton was seen escorting Busch to a NASCAR hauler for a private meeting [at Phoenix]. Hunter also attended but refused to reveal any details of the meeting.(Roanoke Times)(11-13-2005)

Kurt Busch was born way too late. I believe that Kurt would have been a good drinking buddy of Curtis Turner and Kurt might have even tried to fly Curtis' plane. :)

But seriously, Kurt is a throw back to those days of yesteryear. However, with the growth and popularity of the sport, NASCAR can no longer allow such behavior to exist and will do all they can to quell it. I don't condone what Kurt did, but simply because he is who he is, the news is printed to get results. Though we did get the news when it happened, most everyone could have cared less when Scott Wimmer rolled a pickup belonging to Bill Davis and Scott had been drinking. Kurt gets the bigger headlines because he is a champion and because he's Kurt the bad boy.

I did think it was funny the reaction from Roush however. Reading between the lines, it seemed as though Jack was really saying, good riddance. Now someone else will have to put up with him.

A little history..I was a cop

as for your statement. You are right on this since there woiuld be no probable cause if he had passed the test, however, he refused to take the FST but consented to a breath test, which did show alcohol (not admissable in court) but gave probable cause to take him in for an official breath test.

This is where things seem to get a little fuzzy. Since the cop already had knowlede that he had been drinking I fond it hard to believe he'd "let him off" with a reckles citation instead of taking him to a breathalyzer that worked. Not to mention, the testers would have known the status of these machines proir to giving the test because they are required to calibrate them each time, which means they could have told the cop before the test was administered and he could have gone to another location that had a working unit. Especially since Busch refused to perform FST!!!
 
Alcohol related or not if you stupid enough to be speeding, swerving in and out of traffic, and running stop signs, then you take a bit longer to pull over only to be an a-hole when the cop asks you to perform a FST all the while you have the scent of alcohol on your breath you are a 100 percent complete idiot. I can say this because I've never had the desire to drink alcohol, I've never been drunk in my entire 30 years of my life and plan to stay that way until the day that I die. This guy just does not get it. He has to be the biggest jerk in NASCAR today.

Maricopa County Sheriff Joe Arpaio said a motorcycle deputy saw Busch nearly rear-end another vehicle, speed around it to avoid a crash and blast through a stop sign. He was clocked at 60 mph in a 45 zone. The deputy said he tried to stop him, but Busch kept driving. The deputy called for backup and another deputy helped pull Busch over. Arpaio said Busch insulted the deputy by asking what law enforcement agency he was from and saying, "you ought to be directing traffic." Busch reportedly pulled out his driver's license and NASCAR identification and said, "Don't you know who I am?"
 
Sheriff Joe Arpaio is the legendary sheriff who places Maricopa County, Arizona prisoners in tents w/o a/c, has them wear pink and serves them sandwiches.

Sheriff Arpaio also is known as a "no-nonsense" law enforcement officer. The question is, why wasn't a different breathalyzer machine introduced and/or, Busch transported to another facility where a known working breathalyzer machine could be used ?????

It ws mentioned if this had been "Joe Schmuk", the press would not have picked up on it but high visibility is part of being a celebrity and celebrities are subject to the same laws as John and Jane Doe.

Since NASAR is so heavily involved in all sponsorship arrangements, is there a possiblity of outside interference since the driver charged is sponsored by Crown Royal ???? Is NASCAR, among others, trying to cover thier posteriors ?????

NASCAR takes pride is calling itself a "family organization" and recent approval of high alcohol content beverages was not widely accepted among many fans.

To add fuel to the fire, what better example for opponents of alcohol than to have the current NEXTEL NASCAR Champion arrested for drunk driving ????? This could be or have been a major black eye for NASCAR.

There are plenty of unanswered questions with this fiasco and if Sheriff Joe Arpaio is the type of sheriff his reputation has offered, he will conduct a full blown investigation.

The last thing any law enforcement officer wants or needs, is to be accused of malfeasance or favoritism is dispensing penalties based on who the offender is rather than the severity of the offense.
There really may be nothing to this at all and the press and anti-Busch fans are driving the arrest out of proportion, but there are too many unanswered questions backed by direct quotations, creating confusion.

And what if the car had Goodyear tires? Was one of those rental cars that you know who is a spokesman for? Kurt wore Wrangler jeans? OMG. What if he was talking on a Nextel or Sprint cell phone? :confused: This is getting complicated. :growl:

If I was in the same situation, I couldn't tell you I wouldn't have done the same thing.

That is such crap. I would never put myself in "the same" position. I have never been in "the same" position. I will NEVER be in "the same" postion. PERIOD. If there is anything that I despise more is moron's getting behind the wheel when they have been drinking. In addition celebrities that believe they are above the law just because they are famous is such bogus crap. The hell you say that any of us would put ourselves in his position. YOU are not in the same situation so you can't say that you would not do that. It's easy to say because you are NOT rich, a NASCAR Champ, or sorta famous. Fame makes people do stupid things.
 
Sorry, I know who I am and how I was raised. Fame or not I know what kind of person I am and what I would be like. I have the support of great family and friends and know for a fact that I am no Kurt Busch, Terrell Owens, Ricky Williams, or any other moronic celebrity who is full of themselves.

Take the possibility of Kurt drinking out of the equation and the fact remains there is no excuse for the violations committed by Kurt Busch.
Kurt's behavior was irresponsible and immature.
If someone thinks they might have done the same thing under similar circumstances, they too, could easily be placed in the same category.

If its the Intoxilizyer 5000, which it probably is, they aren't fail proof. They can crash without notice and stay down for a while. Plus, these things are very sensentive....when the instument begins its test, it goes through a series of calibrations, including montoring the room "air"...making sure there are no ambient oders. My question is.....how can the officals keep out the smell of fuel out of the room? Especially is the facility is located in the track.

And another reason they may not have offered another test is the time limit may have been up. You only have a certain amount of time to administer a breath test after the arrest had been made. That time may have been up.
 
All I know is when I get pulled over I treat the cops with respect, after all they are just trying to do their job. Had Kurt been cooperative and respectful this whole thing may have never gotten into the hands of the media.
 
All I know is if I did the same thing he did I would be typing this reply from a jailcell right now.
