Yeah it looks like Earnhardt is moving to the DEI 8 now. Admittedly, many fans aren't happy about that. I can't believe a precedent that stupid has a chance of becoming so.Lamar Jackson is a d*+%…he already sued Troy Aikman overreach the use of the number 8 previously, and believes his number 8 is somehow worshiped and of highest value.
Ridiculous. The #8 from the Earnhardt lineage was in play long before Jackson’s parents were born. Jr was racing cars with that number design when Lamar was just an ugly bug eyed little kid.
But…appears JRM has adopted a slightly different version to move away from the Lamar Jackson narcissistic jerky wanker. Let him keep dreaming how amazingly wonderful and important his 8 is to whomever.

Am I the only one who didn't know who Lamar Jackson was before reading the article? Does he plan to sue everyone who's ever worn or used the number? Or maybe his lawyers are encouraging him so they can suck him dry?

I think it's because certain names you just hear without having to watch. Lamar was MVP in 2019 and 2023, was a front runner in 2024. Like it's certainly possible yeah, but the reason it's hard to believe is just because how much his name is out there. But it's possible that maybe you're just not on social media, of watching sports shows. Okay, I haven't found the text but I did a little digging.
Anything can be trademarked, including numbers. Jackson has an existing trademark for the number '8'. Apparently the lawsuit was triggered by JRM's filing for a trademark for the number 8 (an assumption on my part that I was unable to confirm). That definitely was the case in the Aikman lawsuit except it was the word 'Eight'. Those attempts violate Jackson's existing trademark on the number. Odds are excellent Jackson himself had no involvement, just his lawyers taking standard action to protect his 'intellectual property' (a term I use as I understand it legally, certainly not with regards to Jackson's mental skills (or the lack thereof) ).
Jackson (or his legal team) apparently have no issue with the use of the number by other athletes or sports teams, current or historic, as long as no trademarks are applied for. Now can we go back to commenting on the 23FRM vs. NASCAR case? We still need several pages to catch the Deegan discussion.
I expect the DEI-stylized 8 will be associated with racing long after Jackson has been replaced.But I think Dale/JRM can still find room to have a mark that incudes 8 but doesn’t infringe on Jackson’s. The test is whether a consumer could be confused to as to the brand and there are ways to avoid that, I think.
