Robby Gordon

The appeal will happen on Tuesday or so I heard one of those SPEED people say that.
 
I hope at the very least, they reduce the penalty. Can't believe it was the same part no. as the "right" one. Nascar can be tough on its stand, but in this case, some flexibility really needs to be shown.

I just heard that he lost his appeal, Marty Smith was talking about it on ESPN.

Well if you think about it, it is Robby so Smith could have heard that he's lost his appeal even if it hasn't been heard yet. The Appeals committee could already have made up its mind and someone let it slip out.

I heard Marty Smith on NASCAR NOW on ESPN2HD and he said he thinks Robby will win his appeal. Marty also stated this is one of the best (if not THE BEST) appeals since the formation of the appeal committe and he thinks NASCAR, considering everything that rides on this, will overturn the penalty.
 
If Robby wins the appeal NASCAR will just hate Robby more. lol

I think he's better off losing it. :D

I know you're joking, but in the twisted spiteful "you need us, we don't need you" world of NASCAR - you've actually got a point.

I think they'll overturn it, but they'll hate every second of it. France won't drink Jim Beam for a few days.

I keep going to the Nascar site to see what the decision was. Aren't they going to announce it today!!!!!!
 
I just checked it again and still nothing. Nascar Now starts in about 5min., so we'll see if they're just holding out so they can announce it on tv. ???
 
Marty Smith is just saying that "sources" at Robby Gordon Motorsports say the points penalty has been rescinded, but they're upping the monetary penalty to 150k. He's right at RGE and Robby isn't there right now. Rusty says he thinks Robby will be OK as long as he gets his points back since the money goes to the Nascar charity. Rusty said he would chip in some money himself for that. Ok..I'm actually liking Rusty at this moment. LOL

They also said at air time, they still had no word, but just got it from Marty and put him on the air.
 
Robby On-Air Now! GOOD NEWS!

He just got back from the hearing and basically said they he got his points back and they upped the fine for Frank Kerr for "safety" reasons so that others don't try to mess with the gray areas for an advantage. He's happy his team's reputation is vindicated that they are not cheaters. He thanks Everham for bringing two noses to the hearing so they could compare them. He's happy to show he's running a good season so far and shows he and his team did nothing to gain a competitive advantage since the part was changed before the race.

YAY FOR ROBBY!!!
 
That is really great news. It would have been a shame to lose Robby in Nascar.
 
I'm glad for Robby. He's had his share of bad luck with NASCAR, some of his own doing, but nonetheless, bad luck. As a single team owner/driver, I do think they should be much more lenient, even if most don't think that way. Why not let the micro teams cheat a little. It's not like they will even dominate a race or anything. :)

Well i'm glad for Robby, but i must admitt i'm a little surprised that they gave him his points back. I do think it was the right call, hopefully Robby can stay in the top 35 for awhile. Way to go Ray, nice you stuck up for Robby!

Robby Gordon won back his lost NASCAR Sprint Cup Series points today when the National Stock Car Racing Commission overturned portions of his recent penalty. Gordon regained the driver points he’d lost and his crew chief’s suspension was lifted.

Gordon and his Robby Gordon Motorsports team moved from 37th to 21st in the standings after the points were restored. The fine assessed crew chief Frank Kerr was raised from $100,000 to $150,000.

"We see this as good news," Gordon said in a statement. "We are grateful the commissioners rescinded the points penalty and suspension but [are] disappointed by the fine. Still, we see this as a victory for Robby Gordon Motorsports. We feel like justice was done and appreciate NASCAR creating a system that allowed us to take our appeal to the National Stock Car Racing Commission. Now we plan to put this issue behind us and concentrate on making the Chase in 2008 as well as getting the Jim Beam Dodge into victory lane.

"I want to thank the thousands of fans and our sponsors who have supported us through this episode and want everyone of you to know how much we appreciate all that you have done. Our goal is to be a model team in the future and never go through something like this again.“

Gordon was penalized 100 driver and owner points and Robby Gordon Motorsports’ crew chief Frank Kerr was fined $100,000 and suspended for six weeks following the discovery of an unapproved front bumper on the car at Daytona International Speedway. Gordon has been vocal about the penalty since it was assessed, pointing out that the part was supplied to him from the manufacturer and that the error was not the fault of he or his team. The bumper used is one that Dodge is attempting to have approved.

Gordon also questioned the severity of the penalty, though it fell in line with other penalties assessed for infractions on the model formerly known as the car of tomorrow.

In the hearing, the Commission considered several factors, according to a news release. Gordon’s team did not contest whether or not the part was legal.

“The Commission notes and reaffirms the following fundamental principal which is vital to maintaining the integrity of the sport: Regardless of the source of an unapproved part on a race car, the race team that officially enters the car in a NASCAR race is ultimately accountable for that racecar’s conformance, or non-conformance, to the rules,” the statement read. “However, the Commission believes that the facts presented during the hearing represented an extraordinary and unusual set of circumstances.”

The Commission reinstated the car owner and driver points, lifted the suspension and increased the fine to $150,000. Kerr also remains on probation through Dec. 31. The members of the Commission participating in the hearing were Doug Fritz, Bud Moore and Chairman George Silbermann.

Gordon gained fan support following the infraction, with sponsor Jim Beam creating an online petition and writing a letter to NASCAR. In a SceneDaily poll, 72 percent of the respondents voted that the penalty was unwarranted since Gordon did not intentionally violate the rules. NASCAR officials have stated that they do not rule on intent.

It's just something good for Robby, if I say anything my friend who has to do with it wont tell me stuff any more, you will have to wait until it's out to the public. I would hate to lose my passes for the racing season, if I say anything, but it's good for Robby

A little story to tell. My son just called and told me he was at the grocery store and wearing his Dale, Jr jacket and turned around and Kasey Kahne was standing behind hin in the checkout line. My son said to Kasey......I guess that I had better take my jacket off and Kasey just laughed.

That is really wierd!!!:D You have to wonder what goes through other drivers mind when they are in line like that, and see their compeitors jackets in front of them.:eek:

LOL That's so funny! I'm sure they all take it in good humor, esp. if they see any Dale Jr. They all know who's the most popular driver. :D

At my daughter's b-day party back in Jan., her cousin-in-law was telling me that Dave Blaney was his driver. I looked at him and said, but that's KASEY'S NUMBER you're wearing. LOL He went to an auto school in Ohio and said he's good friends with Kasey's brother. Yeah, the the one Kasey used his "HUGE BODY" on the security guard to get back to their RV. :D
