Spencer's Appeal Denied

All the rumor and innuendo about what would happen with the No. 7 Ultra Motorsports Dodge entry came to an abrupt end moments before practice began when the truck was loaded into the transporter and removed from the infield. Apparently, Jimmy Spencer's appeal was denied and Ultra has officially withdrawn the truck from the entry list.
 
Not suprised by the denial of the appeal, but am a little suprised by the complete withdrawal of the #7 from the Truck Race. I guess they didn't have another driver standing by at the track to replace Spencer if his appeal was denied.
 
I really didn't think they would change their mind. Nascar hates to say they were wrong.
 
I don't even know why they bothered to appeal for. Nascar would just deny it anyway.
 
He did have a right to appeal, however I think the decision was already cast in stone for NASCAR ever since this thing happened.
 
Not sure on what basis the Commission would overturn the penalty.

That he didn't do it? That he is sorry now? Not likely.

That he was provoked? These guys are gonna get provoked every day they race and many they don't. Considering the history of Spencer's having been warned about his reactons, it seemed appropriate.

Busch's probation seems appropriate as well. Should Roush pursue his appeal, it too should be denied.

NASCAR's release on the appeal:

On Aug. 20, 2003, the National Stock Car Racing Commission heard and considered the appeal of Jimmy Spencer.. The appeal pertained to a penalty issued by NASCAR following an incident in the garage at the conclusion of the NASCAR Winston Cup Series race at Michigan International Speedway on Aug. 17, 2003.
The penalty assessed by NASCAR was:
- A $25,000 fine;
- Suspension from NASCAR until Aug. 26, 2003;
- Probation until Dec. 31, 2003.
In deciding the appeal, the Commission considered a number of factors.
Jimmy Spencer made a compelling argument, expressing remorse and acknowledging that his actions were wrong.
The Commission notes that NASCAR had previously forewarned Mr. Spencer and put him on notice regarding his behavior with respect to the other driver involved in the incident.
Furthermore the Commission notes that, irrespective of alleged provocation or the exact magnitude of the physical contact, an inappropriate line had been crossed in this case.
It is therefore the unanimous decision of the National Stock Car Racing Commission to uphold the penalty assessed by NASCAR.
The Appellant has the right, under Section 15 of the NASCAR Rule Book, to appeal this decision to the National Stock Car Racing Commissioner.

It was obvious what happened. Jimmy Spencer punched Kurt Busch in the face. Simple.
What should NASCAR have done?? Let him off with a warning?? This feud has been going on for quite awhile, both drivers having been warned previously, and the whole thing came to a head (pun intended) at Michigan.

Had NASCAR not suspended Spencer, the critics would be crying foul because they suspended Harvick for what some might call a lesser offense.

NASCAR made the right call, in both cases. Maybe next time, if there is a next time, Spencer will think first and walk away. And maybe Busch will realize there are some people who will not listen to his smart mouth. They were both guilty. One was more guilty than the other.
Appeals?? Nah !!!
Leave well enough alone. It is over, properly adjudicated and should be final. You might not agree, but this time, IMHO, NASCAR made the right call. And if Busch is smart, he will drop any criminal charges. Dragging this into the court gives the sport a second (pardon the pun, again) black eye. Sorry, couldn't help it. :D

Hopefully the authorities and/or Busch will let the rest of this go. The authorities should not pursue criminal charges nor should Kurt pursue civil compensation.

Neither party is blameless and the best course is to return to racing and get over it. It is not the first and likely will not be the last time this type circumstance bloodies the nose of the racing world. High strung and stressed people will react poorly to situations now and again.

Next maybe they will at least carry the fight to the Big K parking lot, out of sight of both officials and fans.

Why shouldn't criminal charges be pursued? If Busch has to have corrective surgery in the future why shouldn't Spencer be responsible?

I can. This makes twice that Kurt got on the radio and said he did something. 1st spinning RG. This time tried to flatten Spencer's fender. Nascar might have had that tape when they put him on probation. Spencer didn't have to pop Busch in the snot box but I can see why he did it.
 
I can understand flattening someone's fender but that's racing, I dont think just racing and the bumping will merit someone getting socked.
 
It simply amazes me that indeviduals like "happy29" can question the decision of putting that little wuss Busch on probation.

You can not behave like Busch has done without major repricussions comming your way.

The wimpy lawyers of our society want to be able to smart off at will and be protected by the laws and rules. They set it up so that you can provoke an individual with your mouth, and then run and hide behind the law. It's gutless, and cowardly! And in my oppinion, that mentality is lower then a guy who just goes off and belts someone. If your going to punish someone for cole ****ing a person who is asking for it, then punish the indevidual who is mouthin off first before it gets to this level.

Happy 29, you really sound like your in favor of this style of society. You have the mentality of a wimp who wants to talk sh*t and get away with it. I can only imagine what your like to work with or attend school with.

While most of the time I dont agree with nascars calls, Im in favor with what they did here. I think kurt busch has gotin more and more agresive and its time someone got him to calm down a little. I mean nascars call not jimmie spencers actions. Jimmies actions were completely uncalled for, theres no justification whatsoever. He is a grown adult not a kid in grade school.

I for one do not appreciate this type of language or these type of posts. Nothing is getting accomplished with this. You both can discuss things without resorting to this trash. I thought this site had a filter that took out the language. :angry: If this is how things are going, count me out!
 
Silver you have done nothing but cause trouble from your very first post. You have shot out more crap in two days then has been on this board in the year I have been here. You have gone off the deep end with this Kurt Busch thing.
