By the NASCAR rule book, both instances would warrant a penalty that includes a four race crew chief suspension as well as similar punishment for the tire carrier and tire changer due to improper installation.
However the sanctioning body has indicated additional investigation is ongoing to judge intent as it applies to the spirit of the rule.
“It’s possible that we will,” said Scott Miller, NASCAR vice president of competition Monday on Sirius XM NASCAR Radio's “The Morning Drive” when asked about considering intent. “We really haven’t started those discussions yet. Certainly we will review everything that we have. From what we’ve seen so far, it wasn’t trying to go back on the race track with two lug nuts, it was obviously human error in both cases. There’s a lot of discussions internally that have to happen on how we’re going to rule on that. That process will start later this afternoon.”
NASCAR has penalized teams for not having five lug nuts securely fastened in the past and has until now not considered any deviation from the rule being black or white.
But that could change in the case of the two Dover scenarios.
“It’s fairly obvious when things keep occurring that are either competition or safety related, and you feel you need to ramp up consequences of doing said things,” Miller said. “With wheels and hitting two to three lug nuts on the last pit stop, that’s where rules came from.”

Stevens told us during the pit stop that Kyle had a missing lug nut. Paying $10,000 must be cheaper than coming in and going a lap down.I'm thinking they are leaving one off to get out of the job working with Mr. Sparkle. Stevens looked happy when they told him the news

NASCAR announced penalties Wednesday from last weekend’s national-series doubleheader at Charlotte Motor Speedway.
The Joe Gibbs Racing No. 19 Toyota team for Monster Energy NASCAR Cup Series rookie Daniel Suarez was found with one lug nut unsecured after Sunday’s Bank of America 500. Wednesday, crew chief Scott Graves was fined $10,000 for the infraction.
The penalty marked the fourth time this year that Graves has been fined that amount, with other single-lug fines coming after Pocono in June, New Hampshire in July and Bristol in August. Graves took over crew chief duties for the JGR No. 19 on March 29.
