23XI statement on not signing Charter agreement

Overall, the sad part here is that I believe nascar loses another 15% viewership next year, whether they win or lose this trial.
Also, no chance 23xi survives more than a year or two. Denny will be retired after next year as well.
If nascar is deemed a monopoly, which we all know it is, I think other series will pop up on TV and start eating into viewership as well.
Sad era in nascar history.

Everything I've gathered from Dennys testimony is that he promised MJ and Polk a larger return and hes on the hook for 35 mil worth of loans himself so needs nascar to toss him some more money or his butt is in the ringer.

But those aren't stock car racing series. Those are all very different and as we have seen time and again, cross over drivers don't do particularly well so why would full teams have any better luck crossing over?
So now nascar is responsible for them being successful in another form of racing?

No, maybe I misinterpreted your post, but it sounded like you were saying that any team could move from nascar into imsa nhra f1 indy car and have similar business results. That's just not true, the series are all different. Require different engineers, crew chiefs, etc, basically the whole staff. All the tooling and mfg would be different too.

You are a bit behind the curve. Nascar has already been deemed a monopoly. It is not illegal to be a monopoly. If 23XI can prove they restricted other stock car series illegally to compete they might win their case.. Anybodies guess what the outcome can be if they win. Anything from selling tracks, losing charters, damages, or just a fine. Pretty sure they won't be in Nascar long whatever happens unless they settle with Nascar before the verdict is my guess.

On the other hand if Nascar can prove this all came about because of a contract dispute, 23XI didn't get what they wanted so they came up with this Sherman act violation after the fact, Nascar could possibly win it's case.
Yeah, I'm not cheering for one side or the other. Im just hoping stock car racing can get better and grow!

I wouldn't hold my breath. The current TV deal is losing the big channels Fox and NBC in favor of streaming channels and the lower numbers are hurting the viewing and the sponsors.

Ah, I get it now! He's Billy Joel's 'Angry Young Man'!
Give a moment or two to the angry young man,
With his foot in his mouth and his heart in his hand.
He's been stabbed in the back, he's been misunderstood,
It's a comfort to know his intentions are good.

Far too soon to determine any W’s or L’s on either side. But Hamdip didn’t do himself any favors with the jury by responding to cross with clear anger and angst. Also revealed some stuff that isn’t helpful to their poor man claims. But NASCAR will get kicked in the nuts on some things also. The burden of proof is on the plaintiffs and a jury decision must be unanimous. That’s still a high bar to jump.

The haters will continue to hate, doesn't matter the outcome, it's what they do, it's a lifestyle although most are unaware of it.
I'm pretty sure both sides have a point. I'd like to see a ruling that pisses both sides off. That usually ends up being the best one, a compromise.

Nah, Denny's demonstrated his ability to ignore professional legal advice from Day One. Lawyers probably add 25% to the fee when they learn a client has a podcast or other unrestrained media content.
I wouldn't want to be in Denny's shoes podcast or not. Good motivation for him to win races to try to bail himself out of the hole he is in though.

I would bet my law license that Dennis’s lawyer wants him to shut the **** up and get off Twitter.

I don’t know why Denny is going on about his notions of right and wrong. The question is what's legal or illegal and too often that has nothing to do with right or wrong, no matter whose definition is used.

Denny feels like the kind of guy who would not have passed the lesson I taught to high school freshman a few weeks ago on the differences between criminal and civil court. But would be the first to cry about rights.

Win or lose, Denny's coming out of this looking like a bigger jackass than he did going into it.

At least Steve Phelps has made sure that Denny isn't the only one, though.
