Good point, Charlie. JGR did not sue Spire. And none of the reporting about this situation indicates that Spire even knew about Gabehart's attempt to grab and run with JGR intellectual property. And yet we have @Revman saying "Spire is lowlife" and Gabehart's attempt "does speak to the integrity of Dickerson et al." It's a tawdry overreach, based on what has been reported so far.

Also, Gabehart voluntarily agreed to turn over his electronic devices to JGR's third party expert, who identified JGR intellectual property and deleted it from Gabehart's electronics. I would think this process might make it more difficult to claim high-dollar actual damages..:idunno:
 
I’m one that doesn’t think you can use NASCAR, teams or employees of teams & integrity in the same sentence. Actually you probably can’t use those terms in the same zip code.

Everyone is looking for something that will help them go faster so expediency trumps integrity. It’s always been this way to the best of my knowledge.

Gabehart is doing what they all do when they move. He's gathering the guys that he thinks are good to have. After their best year in ages, Gabehart wanted to run the whole show. Gibbs cut him loose instead. Then Gibbs goes to hey, wait a minute, then the whole reality hits lol.

I'm just saying if Spire is paying it then there's a higher chance of them being aware of some alleged taking of data. "Well we didn't tell him to bring stuff over, we just didn't tell him not to..."

When I went through a situation like this the company I was going to work for made it very clear not to take anything with me, as there had previously been a lawsuit about that. I turned over so much stuff that my former employer didnt even have a clue I had it was funny. I walked in with my laptop, folders full of drawings and a handful of thumb drives.

I've been involved with it both ways
1) you figure your stuff out then come work for us
2) you come work for us and we'll fight them for you

Tell me Rev, how much Chevy R07 engine technology ended up in the Toyota Cup engine, since JGR was collaborating on the R07 RIGHT before they jumped ship to Toyota? You can play this game all day if you want. I refuse to get in a twist about this stuff because even if you can prevent the transfer of hard data, you can't erase people's minds, and what they know. It just is what it is, and when it comes to pushing the gray areas (AKA cheating) JGR can hold their own with the best of them.
 
On the Teardown they brought up some good points

- If this was such a big deal then why did JGR wait 3 months to file?
- Why is there nothing in the lawsuit trying to keep him from working elsewhere?
- Why has JGR not wanted to look at Spire stuff?
- Why does JGR essentially want nothing out of the lawsuit other than money?

I'm not sure those talking points are really all that "good"...

- When I read the detailed timeline in JGR's complaint, nothing struck me as excessive waiting or delays in filing. Have you even read it? Which steps taken by JGR, would you skip over to make a quicker filing?

- Probably because expressing an objective to kick Gabehart out of Nascar would play into Gabehart's characterization of the lawsuit as "retaliation" for him leaving the Gibbs family team. JGR's suit does ask for injunctive relief without specifying exactly what at this preliminary stage.

- Probably because Gibbs doesn't want to, nor need to, signal that Gabehart having *already transferred* files to Spire's computer system, in his very first days of employment there, is the crucial act in the alleged plot to mis-use JGR's intellectual property.

Earlier you posted that, if Gabehart's statement of denial is truthful, then "it doesn't seem like JGR has much of a case." How so? Gabehart doesn't deny stealing Gibbs' IP nor does he deny a plan to use it to improve Spire's performance. All he denies is that he has already transferred files to the Spire computer system. And he has shown that he's savvy about leaving digital trails, so why would he even contemplate transferring files during a period of intense scrutiny?

- Because it is a civil action, not a criminal one. Recovery of economic damages is the currency of civil law... full stop.
 
Can they prove Gebhart shared anything? Spire says they haven't. Having company docs on your home computer isn't going to be worth much if that is how far the trail leads.

It could be argued that having a folder named 'Spire' on his computer indicates intent, although I don't know if that will hold water.

Yeah I agree, but 8 million with no proof it was utilized by Spire is my question and of course anything he knows from memory. IDK the whole thing just seems so petty to me.

No proof it was even GIVEN to Spire, at least that we're aware of so far.

Delaying only gives Gabehart and Spire time to clean up any evidence (assuming they would need to). Checking isn't signaling anything, it's passing up an open invitation to find proof.

I just find it incredibly hard to believe that Chris is dumb enough to create a folder called "Spire" and fill it with stolen data. I mean come on my 13 year old son wouldn't even do that
