Why should he be penalized. The car passed inspection. How can you penalize someone for something that "doesn't look right"?

Johnson won 1 out of 4 plate races last year correct? So I don't see this car having a huge advantage over the other teams, if this very car had won all 4 plate races then I'd say there was a very noticeable advantage. Did some one tip off Nascar maybe, is some one fibbing about what is going on, most likely, and we probably will never know the entire truth.It's reality dpk, and I think you know it. HMS lost some key people last year, people who know secrets. If their new team doesn't want to use that secret because they feel it's cheating the template, it's their duty to use HMS to get a ruling from NASCAR. Why would they go to the track knowing HMS has a questionable advantage and not do anything to level the field? NASCAR said it wasn't OK, and now nobody has the advantage.
Whether or not the car made it on to the track makes no difference. It was presented for inspection with the intent for it to be raced. It was illegal, period.seriously folks it was the first inspection before pratice started. i really don't like the 48 but at least they tried

No he didn't win. He was caught before qualifying during inspection before they ever raced. Flashback to 2007.....No. He won and couldn't talk his way out of the jet fuel vapor in his intake.

Michael Waltrip's qualifying time disallowed from Sunday's Daytona 500 qualfiying.
The substance was NOT jet fuel. Waltrip will be allowed to run the Gatorade Duel's in a back up car.(SPEED coverage of the NASCAR press conference). Scott Eggleston will be the interim crew chief for Waltrip. Eggleston won the Daytona 500 with Waltrip in 2001.(2-14-2007)
NASCAR Release: NASCAR announced Wednesday that it has confiscated the primary car of the #55 Toyota team that competes in the NASCAR Nextel Cup Series with driver Michael Waltrip, as a result of rule violations found during pre- and post-qualifying inspection for the Daytona 500. Crew chief Larry (David) Hyder and the team’s vice president of competition Bobby Kennedy have been ejected from this week’s events at Daytona International Speedway and suspended indefinitely. Hyder also has been fined $100,000.
NASCAR also penalized Waltrip with the loss of 100 driver championship points. His qualifying time from pole day on Feb. 11 was disallowed. Team owner Elizabeth (Buffy) Waltrip has been penalized 100 car owner championship points.
The actions taken by NASCAR resulted from violations of 12- 4-A (actions detrimental to stock car racing), 12-4-Q (car, car parts components and/or equipment not conforming to NASCAR rules) and 20-15.2C (gasoline must not be blended with alcohols, ethers or other oxygenates).
The confiscated car and the parts related to the violations will be transported to the NASCAR Research and Development Center in Concord, N.C. for further inspection. NASCAR said the investigation of the confiscated car is ongoing.(NASCAR PR)(2-14-2007)/QUOTE]

He qualified with bad gas. ANY Waltrip with bad gas is kinda scary. 2 ends that just wont shut the hell up.

Michael Waltrip for one.well this should fall under the unapproved parts category, and i am sure someone has been docked points before with a similar infraction.

Sure they did..... Several times. I'm not going to do all of the homework here but here's a link to last years penalty page.Yes it'll fall under that category but last year with the new points NASCAR did not issue points penalties.

I can buy that. Thing is, NASCAR has always stated these fines are escalating until they get the point across. Chad's never quite got that point..... yet.
