For me, it doesn't make any difference what the substance was. He knows the policy and violated it.

To a point I agree. I think all sports organizations and employers have to tread lightly on this. If it's a legit illegal drug then yes. NASCAR needs to be involved and Gallagher needs to get things in order. But if he works out and it was some goofy supplement misunderstanding then things need to be handled accordingly imo. If it was trace/small amounts of THC hopefully both parties can reach some a common sense conclusion/punishment.

Bottom line, this needs to play out....
 
Always interesting to note that those that dislike Kurt generally go out of their way to defend the guy who 1) took anger management classes, 2) went after Darrell Waltrip on live TV in a demeaning way, 3) stated that NASCAR was fixed like wresting, and 4) admitted on national TV that he wrecked a former employee on purpose

Why should it matter if its something minor like THC? The rule is the rule. It's illegal in NASCAR's eyes.

Don't forget it was reported that there was enough THC in Kevin Ward's system to impair him that August night in 2014. Take it with a grain of salt.

Simply because I don't care...lol. If he was battling a back injuries better that than some pharmies. Or maybe he rather relax than drink. I'm not going to get into this "discussion" but as things evolve this topic will take care of itself. It has in the NFL, NBA and PGA Tour.

I'm not familiar with the report you're referring to regarding Kevin Ward. I'd love to see the threshold in terms of levels of THC relative to impairment given THC's extremely long half life. If he ingested THC in one form or another before racing he's a moron. No different than a driver putting back a few before racing (that's had to have happened).

Do these guys get tested for over the counter drugs that can result in drowsyness? It's crazy to think how many guys past and perhaps present have driven high as hell on opiate pain killers.

Again, SG admitted wrong doing in a lapse of judgement. He was aware and is being accountable along with taking the necessary steps to return.

There is no conspiracy. There is no technicality to dance around.

None of that cracked me up. Dr Punch is a great guy and would do anything for anyone and Kurt Busch was a POS that day and deserved what he got.

2) I notice in 99% of these cases, the person never tells us what the taking or why, so I am going to 100% of the time assume that means it's an illegal substance.
3) If you NEED to take ANY type of medicine, supplement ETC, it's on YOU to confer with the sanctioning body and get written approval or find an alternate product that meets their criteria. The excuse of "I didn't know " went out the window a LONG time ago. Under a FAR less stringent testing program, I took the time to make sure it was OK to use over the counter Actifed for my allergies.
4) No matter what the laws are in certain locations and no matter what your personal beliefs are, YOU have to decide what's more important to you. If getting high or being in less pain or whatever is your choice, then you can either quit or take your chances with the system. As health conscious as most of these drivers are and considering the contracts and the moral clauses they are subject to, I find it incredulous that ANY driver would use ANY type of product without knowing EXACTLY what was in it and whether it could trigger a positive test or even a false positive. I like the Dinger, but I thought his excuse was as lame as Mayfield's.

My posts were simply making sure that NASCAR is paying attention to the temperature in the room when it comes to certain things. The sanctioning body has prided itself on being in line with other major sports (NFL, NBA, MLB, NHL, PGA Tour etc.) organizations in recent years. This is one area where they'd be smart to pay attention imo. Obviously the fact drivers are operating motor vehicles at a high rate of speed means thresholds and certain infractions can't be ignored.

Like I said, common sense and sound judgement has to be used by both parties.

I appreciate the perspective you've tried to add. It's certainly more interesting than another round of easy moral grandstanding about a drug-related suspension in which no info or specifics are being released. However, I think it is appropriate to keep such matters private when both parties are cooperative. Since the accused has accepted responsibility, there doesn't appear to be any need for pushback here. There are cases of substance violation suspensions in motorsports where more scrutiny is perhaps warranted. See Broc Tickle's suspension from Supercross by the FIM over an alleged doping violation. He does not necessarily admit fault, and the process there has been less than transparent thus far. He may be guilty, but due process in such cases should occur.

Less than a decade ago, prominent NASCAR drivers were still pushing for NASCAR to actually release a list of banned substances, so that they would actually know the rules. The list is very long; it's not just the common illegal street drugs everyone knows about. Sometimes things aren't as clear and obvious as many would like to believe. This time all circumstantial evidence points to it being a pretty straightforward and admitted f**k-up. I agree that he should go through the program, and he has every chance of succeeding with it.

A young man whom has had the golden chance to live the dream, driving for his fathers race team (obviously this won’t hurt his career too bad for that reason), who was stupid enough to knowingly put that in jeopardy and got caught.

I’ve always got the “my sh1t don’t stink” vibe from him.

Don’t get me wrong, I love to smoke weed as much as anyone. However, I can’t because of my job. If anyone has a job where they’re allowed to, more power to them. This kid prob makes more money than I could ever dream of making. He gets zero sympathy from me.

Here's where it gets a little sticky though. Spencer is representing an AIRLINE, a business that for obvious reasons has to take substance abuse of ANY kind very seriously. It would probably be best from a public relations and a employer-employee perspective for his father to make sure that he isn't just allowed to skate by with the minimum penalty and go back to driving race cars. If it were MY son in this situation, I would probably impose a suspension of at LEAST twice whatever his NASCAR suspension ends up being to send the message how serious this is from a safety as well as a public relations standpoint, and to show that just because he is my son, I will NOT let him get treated less harshly than say a pilot or an airline mechanic.
