Tony Stewart running over someone?

And those psychological reasons were brought on by a tragedy that happened in a non-NASCAR event that Tony willingly signed up for.

That's a good point and I'm curious what the forum thinks here; would you feel the same if it were a physical injury brought about because of an activity outside of NASCAR? Say, for example, JJ has a bad cycling accident and misses a race or two as a result, would it be wrong to give him an exemption because it happened in a non-NASCAR event?

I'm not a fan of exemptions either but not because I think mental injuries, for lack of a better word, are any less legitimate than physical ones. The problem is that once rules go from being black-and-white to gray then sooner or later NASCAR will have to draw the line somewhere. And when they do there are going to be a lot more pissed off fans than if they would have just kept it completely objective all along.

Nobody wants to see a championship outcome altered due to an injury but at the end of the day that's always going to be an inherent part of any sport. Resilience and durability are part of the winning formula and this is true in any sport you look at.

The investigation is sure taking a while.

Possibly the DA is getting a lot of pressure from the family to press charges, or the findings are critical of Kevin's actions and they are trying to give his family some time before disclosing it. They may also be investigating the track for safety. They weren't just investigating Tony, they were investigating an accident to see if there were any criminal actions or safety omissions by anyone involved in promoting the event.

During a sprint car race in August, Ward had climbed from his car after it spun while racing for position. The race at Canandaigua (New York) Motorsports Park was under caution because Ward spun out. He then walked down onto the racing surface, waving his arms in an apparent attempt to confront Stewart.
Authorities said the first car to pass Ward had to swerve to miss hitting him. The front of Stewart's car then appeared to clear Ward, but Ward was struck by the right rear tire and hurtled through the air. He died of blunt force trauma.

I guess this is as good as it gets, but wasn't Ward laps down, Kevin jumped out of the way of the first car, Tony's car was sliding and Kevin moved into it's path instead of down the track, and Kevin wasn't 'hurtled thru the air'.

Other than that, they finally got it right.

I saw a headline that read "Tony Stewarts regrets killing Kevin Ward". Seriously? I didn't bother reading the article.

IMO, NASCAR made the right call giving Tony an exemption. I think it shows empathy and support for Tony Stewart, on NASCAR's behalf. An accidental death is way more serious than merely a "physical injury."
I think Stewart was struggling with whether or not to retire. I think Tony was/is genuinely grieving. I think Tony is genuinely remorseful of the Kevin Ward incident (not to insinuate that he may be guilty of negligence.) I also believe that Tony choosing not to compete, immediately following the death of Ward, was the right thing to do for everyone directly affected, for many reasons.
The outcry on social media and general news media, both negative and positive, by NASCAR fans, motorsports fans and by those in the community, demonstrates that many others were indirectly affected by the Stewart/Ward incident.
NASCAR made the correct decision.

That's seems a little harsh to me. Tony may have went thru with it and raced immediately afterwards without an intervention . I will not claim to know, I don't know, Tony may not know himself. The business as usual thought came from Zippadelli

I do think you have to consider the immediate shock, and these things take a lifetime to absorb. He could have ran at Watkins Glenn and also regretted it for the rest of his life. That would not made him a monster imo.

There is no book or template written on how to handle bizarre tragedies like this one. Not to mention it was probably a sleepless night, a lot better fate than Wards, but still the same thinking ability was probably impaired.
Racers are conditioned not to quit and a countless number of personal sacrifices are required. The mindset is set, I am racing and nothing stops me, the ones who do not never make to the big time.

And I am speculating too, and could be totally wrong myself.
 
If Tony had raced at WG he would have been cast as a cold hearted bastard and the press would have crucified him. The business as usual comment should have been worded differently.
I have absolutely no proof but feel the DA may be getting pressured by the family into filing charges. The family will never be satisfied that Tony didn't plan on killing Kevin no matter what the proof shows.

Ontario County Sheriff's Office has completed investigation into Kevin Ward Jr.s death. D.A.'s office will announce any action late next wk.
 
Given that the DA is now looking at it, there stands a chance that Tony might face some charges. Ontario County's DA office is probably really understaffed and needs a week to get around to reviewing the file. It PROBABLY means nothing, but the DA does have the discretion to decide what to do here.
 
Don't know what this means for sure, if the sheriff is just pass it on to the DA does this mean he can't find any reason for charges so he'll leave it up to the DA?????

Police don't bring charges, the DA does. Police only arrest you on suspicion of a crime.
